I really need to learn how to do that multiQuote thing.. love it :)

Let's try again.

They ENTERED as children. Which is why I call them kids. I'm not saying they're all kids currently. I'm saying they came here as kids, grew up here, and don't know another home. A lot of the ones that qualify for Deferred Action are STUDENTS or REALLY WANT to be students but can't put themselves through school.. unless they work. Hence why they need the EAD !

You're talking about the "no more than 3 misdemeanors" part I assume. If you actually read all the instructions/guidelines you will find out that 3+ misdemeanors is an AUTOMATIC disqualification. In the guidelines it also says that they will LOOK at applicants who have a misdemeanor or two to establish how serious it was and if it's a threat. I think that's to protect the wrongfully accused. Anyway.. 5 common examples of Misdemeanor:

1. Petty Theft

2. Public Intoxication

3. Simple Assault

4. Tresspass

5. Indecent Exposure

Is that what you are worried about? I know plenty of USC who have done waaaaaay worse and are still, good people...who made mistakes. Hypothetical scenario : boy sees a girl or a woman being abused and chooses to NOT just stand there and watch.. that COULD result in an assault charge, no? Does that make him a bad person?

If you think it's a different case then could you please go back a few posts and read what Vip1 said? I can give you more examples, if Vip1's not enough.

Wait, is it the child smugglers that need to be punished or the parents who are trying to raise business people, scientists, engineers, etc... ?

Another hypothetical scenario: family emigrates to US on work visas. Turns out the company that sponsored them is a scam. They have been in US 3 years before they realize it's a scam. Status expires. They can't apply for GC. Kids are straight A students in American schools already (later in college)... but can barely speak and write in "native" language. PLEASE tell me that those people have to be shipped overseas and don't deserve to be here.

We were all kids at one time, so we should call people kids even if they are 60.

At some point you become an adult, responsible for your own calls, US Immigration Law sets that age as 18. Seems a bit odd to me when you can not drink until you are 21 but there has to be some age and I will not argue with it.

As far as they know nothing of their home country, do not speak the language etc etc, there parents knew nothing of the US but chose to ignore that and smuggle their children who also knew nothing of the US, in most cases did not speak the language etc etc into the US.

As it keeps on getting mentioned that they were not at fault, it was their Parents, yet absolutely nothing is being done to track down the people who inflicted this situation. In fact the instructions specifically preclude that from happening.

And nothing to prevent it reoccurring.

Begs the question what is supposed to happen when the current programme expires. At least they have the data for a round up?

Pursuing a relationship with someone in another country is a CHOICE that YOU make. You also have have the choice to find love closer to home too. Which is very different from a child who was moved to this country by their parents. It was NOT their choice. It was the decision of their parents. So how can the costs be the same? That $500 has to be something that most can afford not just for a few.

Completely disagree with you... their parents are old enough and they made the choice knowingly for their kids.

Just like you and me make choices for our kids.

You pay for price for the ppl who have abused B1/2 from your country... even though it was not your fault don't you?

You go ahead and call it smuggling.. I call it getting me away from discriminating and abusive teachers/ academic system and into a country where my hard work is recognized and rewarded. And giving me an upper class community to be a part of and contribute to.

2 years should give La Raza etc plenty of time to set up classes to help them re integrate with the home countries.

Surely?

Here is my take. If there is going to be a delay it will be for those who are ending the system now. For those who are in the churner, it will be a matter of luck, which is no different than now. The line is not linear. My point is that you can let anxiety take the best of you or you can keep your eyes on the prize at the end of the wait. I have no doubt the USCIS is doing the best they can to make sure any impact be minimized.

Ya, well - WHICH casefile types are worked on - is at the direction of the Service Center Director. He tells the adjudicators exactly which types to work on, in some complex 'workload management' math.

Adjudicators, historically, shift on a regular basis, per the direction of the Service Center Director. This fact was well documented here a while back, fwiw.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

So these new applications are going in with all new applications. It is not a true FIFO system.

It has never been a FIFO.

Look how work visa's are handled.

You can assume that resources wil be diverted, there is an election in November and Obama needs the Hispanic vote.

I suspected that. It really confirms that these new applicants will not cause the apocalyptic backlog and thousand-year wait predicted by some.

It confirms the opposite.

From what I have read there has been no major or even minor increase in resources.

These applications have a higher priority.

And as far as numbers, well it was all over the media yesterday, large numbers filling in applications.

And as I mentioned there is an election coming up.

The system is not a true FIFO, ergo, it makes no sense to talk about priority. These applications will go in as will all other new applications.

Which means it will slow down the process for other applicants... the application pool would be much broader now.

Agents processing them are same and if they pick randomly than chances of your file being picked up are low now.

True, but new applications, not only for these kids, are coming in every day. The pool is always getting broader, regardless. Equally there will be others, whose applications will be in front of the new ones.

In he end, the only sure thing is that there will be lots of unsupported speculation, as we are already seeing.

Unsupported?

Who do you think is going to process them, Faries?

Or do you think they have that much spare capacity built in to the system?
