My husband went to the PCC office yesterday in Ghaziabad. It was a long distance from where he lived (4 hours train one way, plus extra time to get to the passport office by taxi). When his appointment turn came, the clerk there refused to issue him a PCC since my name was not on his passport. I have read some of your posts on this form stating that PCC does not require the spouse's name to be on the passport. But I don't know where this law is written. When I talked to my husband yesterday, he was very irritated with the whole thing as he had wasted his whole day traveling, only to be turned away. I do not know how many more months it will take now for him to having to apply both for passport and PCC again. :( He has already taken a day off his work and it will be several weeks before he can even take another day off to go there, also depending on when there is an available time slot for him from the PSK office.

I asked the above on my other thread, but thought I should ask it on a new thread, since hardly anyone probably read that follow up. Does anyone know how to get a PCC without having to wait to get a passport redone? Thanks!

A friend of mine went yesterday (7th August) to Ahemdabad PSK and he also faced the same issue. He was asked to get his wife's name added to his passport and then with the new passport he has to get the PCC done. I think the rules are changed. Now the only option is to get it done as they say. Find any agent who oes passport work, when I got mne done in last January i got it done through an agent and since the day i gave all papers to the agent till the day i got passport delivered at home were just 8-10 total days. Then getting PCC is one day's job. As your husband to start the process asap.

12/06/2011 - Married

01/17/2012 - I-130 Sent

01/18/2012 - NOA1 Date

07/30/2012 - NOA2 Email Received (194 Days since NOA1)

NVC:

07/30/2012 - Case arrived at NVC building

08/20/2012 - Received case #, IIN, gave both e-mail addresses

08/20/2012 - E-mailed DS-3032 (used email template & also attached scanned copy)

08/27/2012 - AOS bill invoiced & PAID online

08/28/2012 - AOS bill appears as PAID

I called my cousin yesterday and asked what her husband did to get PCC. Apparently he got his PCC in late June and he too had to get his Passport re-issued to add his wife's name.

I told my husband to get an agent so we dont get any RFEs for silly reasons.

We have not gotten a Case # yet so we still have time to finish all these little hurdles b4 Visa interview. if my husband was in A'bad, I'd help him, but hes not from A'bad, so an agent will be perfect to help him out.

My husband was asked the same thing from PSK in New Delhi -instead he went to his hometown (where he got his passport) and got the PCC from there (he had to go for other docs.), he also got a policeclearance certificate from New Delhi (where he resided) that worked for us. He didn't want to renew his passport because he got it 2 years prior. We didn't have any problems.

It all depend up to official. It is not mandatory to have spouse name in passport, but some official won't agree. Overall, if there is no alternate option, then you have to do exactly what they need, else it would be just time wasting. It is not worth to argue with them.

Getting passport re-issued wont take the time if applied under tatkal then it may take up to 3 business days or so.

My wife got PCC without a problem even though her passport doesn't mention my name. This is in Hyderabad though and not sure if rules differ from state to state.

Thanks everyone. My husband is struggling financially and does not have money for Tatkal, so we'll just go the regular route. Does anyone know if they are willing to allow for PCC appication at the same time as the appointment for passport re-issue? This would be nice, as it would save him one trip to Ghaziabad.

Also, right now we are in the NVC stage, as I am just about to send out the AOS package. I am wondering what will happen if we have to apply for a new passport. I do not recall if we submitted his current passport details in the I-130 package, but I hope it won't be a problem if he gets a new passport. :unsure:

I obviously can't answer any of your India questions but if he gets a new passport in the process it won't be a problem. He will just bring the new passport to his interview. If there are any other changes beside the passport number he should mention it and bring documentation if he did anything like a name change.
