I-864 form confusing!!!

HI vjs!

My wife is sponsoring me to go to usa, I need to know how to fill out question 1. on the I-864 form.

She has never had a job and her parents agreed to co-sponsor me to go to America. I know she is required to fill out a form I-864

and her parents I-864a form.

I am not for sure which box she is suppose to mark on 1.either

a. I am the petitioner. I filed or am filing for the immigration

e. I am the first (of two joint) sponsors, ( there are three sponsors

in this case then) 1. wife 2. mother (main sponsor) three ( father - needed to make the required amount of around 34,000)

there is 5 in the house hold including me

Simo...just curious about something, if your wife has never worked before, or does not have the assets to support you, how does she plan to support you should you get a visa. I am sure the consular will most likely ask you the same question during your interview.

she is still a student and living with her parent.

One of her parents as joint sponsor would also fill out an I-864 (joint sponsor is the proper term here). It would be the other parent that would fill out the I-864A if they were combining income.

You wife ticks "I am the petitioner." If her mom is the main sponsor, then her mom ticks "I am the first of two joint sponsors" on her I-864.

Household counts go like this, your wife includes you in her count but not her parents. Her parents include you in their household count but not your wife.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Your wife has to be living with her co-sponsoring parent to use the I-864A and must show proof of relationship with her parents as well as proof of same residence. She will also have to go on to the IRS's website and print out documentation that proves she is tax exempt, also if she is claimed dependent on her parents tax forms it will help a bit.

If she does NOT live with her parent or parents then they both have to fill out I-864 forms.

As for how does she plan to support you when you arrive, her co-sponsor has obviously agreed to do so.
