I thought visa journey was about giving people good advices but not to criticize people. However I found some harsh comments in this tread. I didn't expect that from here. We all know that he lies but don't make it worse by criticizing. As a matter of fact we all were and are aliens.

Ahhh.. but the difference is we all went through a lot of time, worry, and money to do it LEGALLY....... and it's ####### that someone who possibly came in illegally dares to ask us how to get around it.

I can certainly understand how you might feel outraged but you can never know it unless you're in that person's shoes. Nobody is telling this person how to get around the laws, so much as the advice has been consistently in that he should solicit legal representation to address it before a court of law.

Good, I am glad they discovered his lie. Depending on the details, his whole immigration file was based on fraud (he lied and said he was not married when he was), and they can revoke his Greencard and deport him.

Without the details, no one can help you. No on is going to help cover up fraud, however.

He either was not eligible for his family category by being married (maybe he came in under an unmarried child category), or he used this lie for some other reason.

according to him he was petitioned by his sister, i ask him why u have to lie about it, he said that's what his sister told him. he was already 45 years old (not sure) when he came here in the US.

If his being married would have had no bearing on his immigration process to the US in the eyes of the USCIS, he should be able to renew his green card and remain a LPR, his fault being lying to an immigration officer in the process of obtaining citizenship. A lawyer might be able to help him straighten the record. However, if his marriage abroad should have prevented him from obtaining LPR status, he might consider leaving the country voluntarily before deportation proceedings are brought about. It can get ugly in these cases.

At 1 point he did hired a lawyer,but i think he already gave up. i feel sorry for him, nobody really wants to be in his position.

he came here legally, he was petitioned by his sister and his sister told him dont tell the CO that he's married, he came here around late 1990, i ask him why he had to lie considering he was mid 40's when he came here, IDK what were they thinking back then. i really didnt ask for more explanation form him he basicly telling me his story.

I have a friend and his citizenship was denied, I really didnlt ask for the details, but he told me when he had his interview to migrate in the US he said that he was not married, but when he applied for his ctizenship he claims they found out he was married before he even get here in the US. and now his greencard is about to expires. what he should do?

What he should do is hire a good attorney to represent him, but then again, there is no guarantee that an attorney will help him in this case. So, If I were him, I would prepare for the outcome of my lie, which may ultimately be a deportation. I understand what he must be going through at this moment but sadly it is what it is.

Sounds like they (I am pretty sure even his sister should be liable since she most likely filled the I-130 and also lied) lied in order for him to fit a unmarried brother priority which would be cheating the system if he was already married.

There is only one category for a USC to petition a sibling. It doesnt matter if the sibling is married or not. There is no unmarried sibling category.

Yes, to gain immigration benefits from misrepresentation, for sure. It's just harder to have concrete evidence that the sister lied, or that she wasn't informed about his marriage. In that sense, she had been honest. Otherwise, if proven, there is a consequense which is also stated on most of the forms and instructions under the section "penalties", or INA: ACT 274C - PENALTIES FOR DOCUMENT FRAUD

You hear harsh comments… coz ppl get tired where ppl lie to jump in front of the line and not wanting to wait their time.

Since there is hardly any details in your case, there is not much anyone can help with.

Lie and misrepresentation to immigration is big big thing…. Even your granted citizenship can be revoked on that base.

So ppl need to understand lieing and mis-representing might sound good idea for shorter duration but it is very bad idea for longer duration.
