This is my first posting . I am excited to see a support network for people dealing with immigration issues. I am a permanent resident since 2004 .I am from South AFrica. I sent my N400 off on July 19 2012(not the issue). I also sent an I-130 for my daughter who is 19 . My husband filed as a stepchild. She is a 2nd year in college.

My question is if can I use the form I-824 follow to join for her to join us sooner? I/m not sure if this form is only for the initial adjustment of status in 2004 and permanent residence also granted in 2004?

any advice will help

Follow to join only works from within a year of the parent getting the visa. Assuming you married your husband before daughter was 18, it should take less than a year for daughter to get here.

Thanks so much for the info. I thought that 1yr was the cut off but needed confirmation. She was 11 when we got married. We have been married 9 yrs and have a 7 yr old daughter together .I am worried because she will be 20 on Decemeber 2 ,2012 and time is running out. She is a student in South Africa and want to finish her degree there but I want her to at least have the option of coming here and in dealing with immigration many years ago ,I am going into anxiety mode again..

He filed the 1-130 pettition on July 19.

and my N-400 on the same date

I have my finger prints date on 8/10/2012 this friday.

Since your husband filed, your naturalisation application doesn't matter at all.

She has till she is 21 before she ages out, and she'll have the visa by then.
