Dear all,

I am a USC and would like to know if my twin sons would be eligible for the K-4 visa. My sons I-130 sill pending but my wife's I-130 has already been approved and transferred to the NVC. We need to move forward with my wife's case but our son's pending cases are holding us still. My wife gave birth to our twins 10 months after filling her I-130. That explains why her case got approved before our sons'. I filled the I-130 for my sons on June 2010, received RFE on October 2010 and havn't heard from the Detroit Office since. I have tried to contact this office through my Senator but all I hear is wait. My twin sons are now 3 years old. I would very much apprentice if anybody could tell me what my options are?

How long have you been a USC ? If you were a USC and met residency requirements your sons are USC's also. I supposed they aren't . If you wife is getting an I130 then your sons don't get K4 visas. The I 130 should be approved already , if you recently became a USC did you let them know to upgrade your petition ?

This will not be over quickly. You will not enjoy this.

Thanks for your response. I upgraded the petition 14 months ago. Is there something else I can do to make my children's petition move forward? Is there a way I can have my children enter the US while the petition under process?

Now that the wife's I-130 is approved, you can ask for an expedite with an ISO at USCIS.

Use a telephone, get an ISO, and ask for it.

Pay particular attention to their intake process/procedure, and do it, to the letter.

Well, I called USCIS and asked for an expedite so I hope they honor my request. Can you please elaborate more about the intake process/procedure you mentioned?
