I am not sure what you mean by traffic stops. I think we are speaking of different things.

If we find out what the moving violations are we can have a better feel on how to proceed. It seems that the ICE agent felt they were serious enough to keep him locked up.

Ok one more time. he dude had prior moving violations. He got nabbed because he walked into a stake out for another illegal. The ICe agnet checked his record and it came back with 10 priors. The supervisor told him to free him because he was not a high priority target.

ICE agents do not perform traffic violation stops. They have no jurisdiction on traffic laws. Sessions need to take a crash course in Constitution 101.

Is he working or is he off for five weeks with the rest of Cngress?

This is what I was talking about... You keep saying ICE can not make traffic stops because of the 10th AMND. That is false.

It still would be nice to know what the moving violations were. And if you or I had 10 priors and we walked into a stakeout for another person and the police checked our record we would be arrested - just saying.

No we are not. You said they can not make traffic stops. So what were you meaning to say.. ???

It still would be nice to know what the moving violations were. And if you or I had 10 priors and we walked into a stakeout for another person and the police checked our record we would be arrested - just saying.

I really have to disagree. If they got us as mistaken identity and we had 10 former citations for moving violations and no outstanding we would be cut loose. However he did have one big outstanding. He is an illegal alien, which is illegal.

I was talking about the difference between the powers of the Federal Government and it's agencies and those reserved to the States, by the X Amendment. It's all boring Constitutional law.

I know what the 10th is. I also know that it does not prevent federal officers from making traffic stops.

The 10th is rarely if ever given validity by the Supreme court for declaring something unconstitutional.
