not approved yet,more evidence my fiance income

Hi guys

I need some help please.

I`m Erika from Brazil and I need your help .I had my interview for K1 visa on 07/24/2012 and the consul asked me more proof of my fiance`s support .. because in 2011 he stayed in Brazil for 10 months and just declared 2 months of taxes ... Anyways i went back to the consulate in the same day and I took with me the paychecks that shows from january till july of this year he made $35.000,00, and after two weeks waiting for an answer, I got an email saying that I wont get my visa yet because I still need to send those documentos:

Financial Support:

(X) Tax return - 1040 (X) Petticionary of 2011 or transcription ..

(X) W2 ( X) Petticionary of 2011 ..

But what I dont understand why they still want those documents if i took in the interview ... What do you guys think Should I do right now ?? Should I send again the same documents ??? I have doubts because They didnt make clear if i need a co-sponsor or something like this .. I guess if they wanted it they could say right ?? .

Any help right now will be welcome .. Thank you so much

Erika, if you already have these documents, the consulate may need to see them again. Just send them in.

so when him was here, his not working. But in october 2011, him go back to EUA, and there (EUA) his worked for two months. So your income from 2011 was only 2 months you understand? in 2011 he does 9 mil sorry my english

You took those documents to the interview? Give them anything they ask for. If they ask for something you already showed them at the interview, give it to them again. Seems that they are asking for 2011 tax return 1040 and W2s AND the tax transcripts for that year. If your fiance mostly worked abroad in 2011, does he have any proof of the income he made in that 10 months? You have already proven that he currently makes enough so give them what they are asking for and anything else from 2011 that shows his income.

so, when he was here, he not working in nothing, just came for family reason, and when he was back to EUA he working for two months and you income was 9 thousand dolares, but the first time i sent the pay check and for jan an jul he does 35 thousand, is very good you don think? I realy dont know what they want, iwas send everthing sorry my english

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

OP, please be a little patient. The Visa Journey people who can help you may not be online right away and see your post. They are all volunteers here, and are not here all the time. It gets confusing when you ask the same thing many times, and get answers in several threads.

If they want you to send things they have already seen, go ahead and send them. Send them anything the ask for.

I can explain it to you. But I can't understand it for you.

Hopefully I can summarize the conversation we had with Erika.

Her fiance, a naturalized citizen from Brazil, stayed in Brazil for 10 months in 2011 and worked 2 months in USA.

2011 tax returns reported $9000.

At the interview, she gave the W-2 and tax return for 2011. along with I-134

At the interview, she was asked to provide more proof of income. She returned after printing out the email with the scans of his paystubs for 2012 that totaled $35,000 and handed the documents to a consulate worker. She received an email confirming receipt of those documents and they were going to be analyzed.

She has now received an email requesting her to send fiancé's 2011 tax return and W-2 and they will finish processing the K1.

So that is the story after talking with her for about an hour. I have to admit that I don't understand the request to send documents that were handed in at the interview originally (2011 tax return and W-2). But, as I have told her, she should resend anyhow as they requested it.

Her question now is should they get a joint sponsor (they have someone who is willing to do that)?? Along with resubmitting the documents requested?

The good news is that they did not deny the K1 and they have given her a timeframe of a year to resubmit or they will consider it abandoned.

Any advice or input would be greatly appreciated.

I'd resubmit everything again with a personal letter explaining they can get a co-sponsor if necessary.

I definitely advised her on resubmitting everything for the affidavit of support to be sure, including the emails stating they had received the other documents. She is thinking of going ahead with a joint sponsor anyhow. I guess it will not hurt. I don't know about that.

Her english is poor as evidenced by her earlier posts. That is why my wife and I skyped with her. She is aware that I am posting here on her behalf. I will pass on all recommendations to her as well as she will read them to the best of her ability here.
