Well, if what you are saying is how this whole incident went down, then she could be in serious trouble for filing a false police report. I don't understand how you could have as many witnesses as you do(your brother being at the scene;your familiy knowing about her lieing, then confronting her about the subject) and still be charged with a felony. You cant be branded as a felon if you are found innocent in a court of law. There has to be probable cause when obtaining a warrant for an arrest. Yes, you can still be arrested..probable cause can be the evidence of bruising and/or cuts or scracthes to the skin of the victim..eye witnesses..previous 911 calls..etc. But a felony charge is not going to stick to you unless there is proof of an eye witness that saw you hit her, or evidence of dna or injuries to and on the suspect. Such as skin flakings of the victim under the finger nails of the suspect, swollen hand, busted vessels/bones of suspect due to the blunt force of punching a subject..evidenced of weapon used with dna of victim/prints of suspect...several factors come in to play in order for a felony to stay. Im majoring in Criminial Justice and have also worked volunteer time with the local sheriff office in the past. I cant make a valid say on what will happen, because I cannot look at all factors of this incident, but with your given details, she has no evidence ..only her word..which in this case officially insnt sufficient if there are no wounds or bruises to back up her claim. This could be a case of the foriegner not knowing the law very well and then being taken advantage of by her peers in a tasteless prank by them. Im just being fair and balanced;looking at both sides since all I have is one side to go on. All in all, if you are being honest about what happened, in which I have no reason to doubt, then this case would be thrown out of a court of law. From what you have given, there isnt sufficient evidence for a conviction. If so, then anyone could say whatever and have whoever arrested, charged, booked and put in jail for anything. Thats just not how the system works, or we would all be in jail for something someone said about us that just was not true for just whatever reason. But still, the question remains as to why she will not have the charges dropped if she says it was all a "they put me up to it," senario...?? Your best bet would to be hire an attorney...we here at vj are not a jury and cannot see all the facts to be weighed..we only see your side, which Im not saying is false..but we cant honestly give you an answer without being fair and ballanced..at least I cant...it would be wrong. I hope you can get you situation solved.

All she needs is her word to have one charged. Keep in mind, that criminal domestic violence also includes verbal threats and/or perceived threats. She would have had to swear out an affidavit, which if she lies she will have committed perjury. But in the world of CDV, this is all it takes to get a person arrested. In CDV cases, the officials tend to err on the side of caution and let the alleged defendant have his day in court.

The bigger picture here is that there are some holes in the story of the OP as to how this went down. Being stopped in the car, then a detective showing up. If indeed there was a warrant for the arrest, the cops would have taken him in and the detectives would have interviewed him there.

I am off the opinion that this is a troll to just get things stirred up here in VJdevil.gif

Is it possible for him to send his 'wife' to live with his sisters female family?

I ask because who the hell would want to be with a lying idiot of a significant other who gets influenced by her 'new little friends'?

It would be safer for him to not be around her so she can't make up new lies.

Could he support her from afar, as long as necessary to clear his name from the accusations? Then when that's fixed, get her deported?

Would be nice. It's because of leeches like that, that the system of immigration visa is more complicated IMO. Who wants to invite in the dishonest?

In some cultures, if you manage to 'fool' someone, you're not the 'bad' one. They are the 'idiot' so they deserve it.

As a guy said above, she's probably banging someone else or she's checking a guy out or dreaming of being 'free in America, land of opportunity'.

You don't just go around telling lies about your husband who worked hard at bringing you to his home country, signed an affidavit of support (which is a considerable risk to him), just to turn your back on him when a bunch of women put you up to it.

I'm sorry if I offend a bunch of ladies here, but there's a reason I don't trust other women easily, as a woman myself.

Not a lot of good advice at times and not exactly jealousy-free (even for closer friends).

So yeah I think she's not into you if she's going to create fairy-hell-tales to tell the police and get you in trouble. She's just looking out for herself. Run while you still can. Run while there isn't little people called children involved in the equation. Is a liar the kind of woman you want as the mother of your children?

IF there is to be any redeeming, she will have to write a confession of having lied and will have to present this to the Police and whoever else is involved already. If she won't do it, well you have your answer.

I guess I'm pretty harsh in my explanations but I'm a no bs kind of person and I'm as blunt as they come.

Nov 24, 2011 - Received NOA1

Mar 23, 2012 - Met in Montreal as happy fiances. Proposal in person. <3

April 21, 2012 - Received approved NOA2

Sometime in May, 2012 - Received packet 3 letter.

Working on it about to submit...

Considering everything you posted here it sounds you are living with an abuser and/or an opportunist. Remove yourself from her presence and do me a favour "remove" her from our Country as well,we don't need a freaking #@%%^$#&%$ in our streets.If she didn't receive her GC yet I bet she will file for Vawa.

Good point, I was kinda wondering how he had a felony warrant and said nothing about jail or bail. They wouldn't catch and release him if there was an active felony warrant.

Exactly, he would have had to have seen a judge to get out, and if there was sufficient evidence, a large bail would have been recommended.

I was stopped and the undercover unit told me that the detective wanted to speak to me we wait on the side of the road for about 15 minutes then they took me to the station at which point the detective came in with the arrest report and i was then taken into custody. he didn't ask me any questions at all

I didn't start this tread to talk about the incident it was to inform you guys that it doesn't matter if anyone's around you will stil be arrested. and I got stopped at mid day so I went to the county jail for a charge of dv there is no bond so I had to stay the night in jail and then the judge gave bond.

Not exactly, friend. :no: The post has several holes and by all means, I must admit, it sounds completely nuts....but I'm just not the type of person to call someone a liar without reason. If you read my post again, you will notice that I never said I believed anything, but also, I never called them a liar either. :)

I've been pulled over by a Dectective before on the street. They just don't sit in the office and work on cold cases you know.

OK, So what did the judge say? And yes, it does matter who is around. Your witnesses you claim from 5 weeks ago will be called to testify.

You have been arrested, not convicted. You should already have your date set to return to court.

Listen I'm not here to prove my case to you guys I'm just here to warn you guys to stop giving people a false sense by stating if you and your other are having problems it's best to have someone around

did you read what I said I stated the the arrest report has a date of 5 weeks ago but notary seal on the actual report was just stamp 2 days before my arrest. I was kind of think that if she had any kind of marks on her it would be in the arrest report. the arrest report doesn't list anything at all about marks on her, so I have no clue when she went to the police.

I have a stay away order so I'm getting my information through my aunts. they said that she made the report in school but her school is in a completely different city from where I live so why isn't the city her school in handling the case that might be why it took so long. but, if a woman was getting beating up to the point they felt a felony occurred they would just leave her there?????
