Hello All so I need some help,

my wife had an interview today at the London Embassy, she was told that the pettitionor(I) need to be domiciled in the US. at the time when I applied i was living in the US. I currently work for a DOD contractor and residing on an Army base in Kuwait. She was also told to get an affidavit from a Third party since I am not domiciled in the US. I thought I am domiciled since I work for a US company and pay my taxes, registered to vote in the US and only been out of the US for 7 months so far. My current contract ends in December and we were planning on living Kuwait and then move back to the US. she was told her application is not denied, she doesnt have to come appear a the embassy again just send in a third party affidavit, and something that shows we will be living in the US like an apartment lease paper.

I am currently using my Sisters address in Texas since I don't have my own place back home because I didnt needed one. Should a letter from her that we will reside with her and arrange payment once my wife receive her visa be sufficent?

Am I not considered Domiciled in the US because I work for a US company and Pay US taxes?

Unless you're actually in the military or on official government business abroad you are not considered to be domiciled in the US. I had looked into this when my husband was considering a similar contract to yours, as I needed to know if there would be a problem with me accompanying him and living away from the US as a green card holder.

You can just show that you intend to take up residence in the US at the same time she does, she can't move over before you though. So affidavit and lease to show this yes.

Have you worked out how she will stay with you in Kuwait? When I was looking into it it seemed like I could maybe stay for three months at a time but we'd have to rent a place outside the base.

So I need an affidavit from a third party regardless? Intend to reside in the US would be something like If i would lets say rent my brother's rental house upon her arrival in the US and I accompany her to the US? DO i get a letter from my brother in that case that we will rent his place once She is ready to move to the US.

Yea she will be staying three months at a time till we figure out otherwise.

This domicile issue makes me a little angry. I am in the same position regarding establishing domicile. How can they expect me to, lets say sign a lease in the US, without guarantee of approval of the visa? Sorry to vent on your topic, I just had to :angry:

Those of us doing DCF have to prove this too. What most people do, is show resignations from jobs, lease on a house (or contract drawn up with parents/siblings etc to live with them), job offers in the US. Maybe a letter from the company you work for to state that you will be leaving in December.

they actually want a person to leave a job>? but at the same time they need guarantee of support. a bit strange no? the interviewee told my wife to get a lease letter. I am hoping that is enough. is it?

I didnt say to leave your job! Dont do that :lol: I said people use those when they are leaving where they are to re-establish domicile in the US when they have been away. I dont know if you work for a US company where your job will continue when you get back. If that is the case, a letter from your company explaining you are temporarily abroad for work will do the same job.

I work for a US company but i wont be guarenteed a job back home, nor can I just resign.. I guess my question is how do I prove my intent of establishing domicile in the US,

THe counselor asked her to get a third party affidavit because my income is over seas. and show intent of us moving to the US.

The part about leaving your job is problematic when the literature tells you to make no plans, including quitting a job, until you have the visa.

Those instructions are directed at visa applicants, not petitioners living abroad.
