I'm really hoping someone can advise me.... In June 2011 I flew over to Ohio to spend some time with my fiance for him to meet my son - we had return tickets - We decided that once there to get married and consulted a lawyer who suggested that as we had not intended to we could simply apply to adjust status. We paid a retainer and was just about to begin the process when my father in England took very ill and I really had to return to see him. I had overstayed on my esta by this time by a couple of weeks - If we had of known the pitfalls about marrying whilst on an esta - we most certainly would not have done it and I would have certainly returned to england prior to my overstay.

We have recently submitted our I-130 to Chicago and my husband in the US received our receipt number. this was about 5 weeks ago - our app is with Vermont service centre and I have been checking the case status and all it says is it is in initial review.

What is really worrying me now is that I will be automatically rejected because of my overstay. I am terrifed that this will be the case and I will never be able to start my life with my husband. I am so so worried - could anyone please put my mind at rest - I have tried to find the time frame for a decision to be made and its driving me insane that I cannot navigate the links - I have a lot to learn

Okay rest your mind. The US is most forgiving and you fall under the 180 days time is forgiven since you are marryied to a US citizen.

The USCIS is not looking at your overstay. However I am sure the topic may or maynot come up during your interview. But you are okay. Just breathe.

You are just at 5 weeks you still have a ways of waiting at USCIS probably another 4 months. % months is their goal and VSC has been very slow but picking up a bit. So after USCIS than NVC another about 2 months than interview time. So buckle up you have about another 6 to 8 months before interview.

Okay rest your mind. The US is most forgiving and you fall under the 180 days time is forgiven since you are marryied to a US citizen.

Oh thank you so so much - I've sat here in tears for the past few weeks - Its such a long long wait - I tried to check the waiting time for vermont and they seem to be saying if they are working at a quicker pace than their estimated one thwy will still put the estimated one - which at present stands at 5 months - I understand that t here is a wait after that - I don't care how long the wait will be - just couldn't bear the thought of not being with my husband. I saw one on here today who got their NOA2 in 36 days!! 36 days!!!! I was positively green with envy - but very pleased for them too - thanks again for your help its rfeally helped ease my mind :)

Thats the spirit. Look at it like I have heard countless people say here. Brace for 5 to 6 months and if it comes sooner like me 3 months 1 week 5 days. Than thats a plesant surprise you weren't expecting. I know I wasn't expecting such a blessing.

And I feel ya on the 36 days green with envy. I friend of mine here we had same NOA1 date and 25 days she was done. She has interviewed and husband home with her already. That all started just in March. Goodness.

Vermont i guess had to handle all those emergency Syrian people escaping the horror, but I hear now they are getting back to adjudicating. Follow your timeline on VJ it is pretty accurate but not written in stone you know.

But one of the pluses of getting married is forgiving those overstays and illegal work. See God Bless America. We love our foreign spouses. :dance:(L)

Just hang out on VJ post, read join in the fun. At least you are from a country you can probably still visit. Have you tried to come back and visit? But than if refused thats a wasted ticket. Okay forget I said that. Sorry.:blush:

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
