PLS HELP! I-864A question

im filling for AFFIDAVIT OF SUPPORT(I-864). I am filling in behalf my wife who is not in this country.. but my income is below poverty line so, MY FATHER is filling I-864A to support my AOS... MY PROBLEM is this:

MY FATHER and MOTHER filed for JOINT TAX RETURN when it stated that it's an INDIVIDUAL TAX RETURN on I-864A..... so how does this work?? do i disqualify my father and find another person to fill up I-864A??? i need some opinion on this.... thnx

His income is on the joint return. A large percentage of married couples file jointly. As long as his income meets the requirement for dependents in his household plus your wife, you will be fine.

Your dad should file a I-864, not I-864A, and his wife then files I-864A.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

A I-864A is for a dependant or someone who has joint resources with the I-864 sponsor.

Unless your dad is disabled or otherwise financially dependant on you, and you file taxes with him listed as your dependant, it would be more appropriate for him to file as joint sponsor, ie a separate I-864.

hmmm... ok this is becoming a little clearer now (i think)... so scrap the I-864A right?

i am the petitioner so i must submit an I-864 for my wife who i am sponsoring

AND my father should also file/submit his own I-864 since my income is below poverty line?

tell me if this is the right thing to do pls... thnks alot for helping and if anyone else has inputs/ suggestions feel free to comment

Yep. Then if your father files jointly, or you want to add your mom's income to your dad's, she can file a I-864A.
