Hi everybody,

My fiance and I got our NOA2 this week. I'm trying to gather my paperwork for the embassy and this is my concern about the Affidavit of support: My fiance makes enough money, but has had three different jobs within the past six months. He won't be able to obtain a letter from his current employer stating how much his annual income is. On top of that he didn't file for taxes last year. I'm worried this might cause problems at the interview. Is there anything we can do? Advice would be greatly appreciated. Thank you!

Welcome to the forum.

First things first, correct your timeline to reflect the correct service center. You list on your profile the California Service Center, yet your timeline shows Texas Service Center. You should correct your timeline to the correct service center, the California Service Center (assuming the prefix on your I-797c (NOA1 starts with 'WAC'). The Texas Service Center does not process K-1 petitions. This will result in you having more meaningful statistics.

The obvious question is.... If he makes enough money, why didn't he file his Federal income tax return for 2011? Does the US citizen have adequate assets to satisfy the financial support requirements? Check the guides, particularly the step-by-step instructions, for details. Check whether the interviewing consulate allows co-sponsors on the I-134, some do, some do not. If they do, suggest that you consider lining up a co-sponsor in order to meet the requirements of Form I-134.

Three different jobs within the last 6 months, no way to verify through his employer how much he is currently earning and no taxes filed last year? I am thinking the CO might see his financials as not being stable enough to keep you from becoming a public charge, so he may want to go ahead and get a co-sponsor lined up.

If he was required to file taxes last year, then he needs to file them now, before it is time for the affidavit of support. If he was not required to file, he needs to provide a statement as to why he was not legally required file taxes.
