Hello everyone. I have a question. I am currently submitting a K1 Visa petition and I am wondering if I can expect problems because I currently hold a TS (Top Secret Clearance) for my Job. Does anyone have any experience or advice then can give me in a situation like this? My Fiance is Chinese. We intend on being completely honest about everything. Will we be denied because I hold a TS clearance? Is it possible I can loose my Job? Thanks again for the expert advice =)

You shouldn't have any problem on the Embassy/Visa side of the house. But I don't know about the job or losing your clearance. That pretty much depends on what you do and what level TS you have.

If you traveled with out followup issues probably nothing. My partner is Agent and cannot travel to ex; China without mucho clearance and will probably loose his TX clearance.

I have just the basic TS (top secret clearance. Nothing special. I work in IA (Information Assurance). I know the US government is very concerned with China concerning IA. I am hoping that because I am honest and up front about all my dealings with my Fiance that this will not be a problem. Thank you very much for the response =)

Talk to the people you work for to find out what, if any, issues could arise. That will likely get you more info than VJ can provide.

In the past I recall some VJ members having their background check take longer because of their clearances.

? Will probable loose his TX clearance? What is a TX clearance? What do you mean "mucho" clearance? I have not had any follow up issues.

Thank you for the response =) She works for Lexmark currently so not a political Job. Taking longer is fine as long as we get approved. I have received my NOA1 but not received my NOA2 yet but we still have about 1 1/2 months time before the average of 5 month processing time takes place. I certainly would not like to loose my Job. My income would be less then the 125% requirement with zero Job lol.

Any idea if the hold up on background check also applies to law enforcement as well? I'm hoping not!!

I assume you have keep your work informed about your fiance and your travels out of the country. Depending on the actual contract you should be ok as long as they are up to date about everything.

Thank you for the response =) Yes I have been upfront about my interactions with my Fiance. Both of my trips to China were not considered a big deal by my security officer. If I had a higher clearance than a TS I may have had some more issues. I did not even need to fill out any paperwork according to my FSO. Basically from the sound of things my clearance should not interfere with the K1 petition but I am more worried about what will happen after she arrives in the USA.

concur with most of the above as it's not always a sure bet on the bring up investigation.

This is true and it also depending on the contract. I am in the same situation and as I will be sponsoring a foreign fiancee, and thus I am losing my TX clearance.

I have secret clearance, and so far it hasn't caused me any delays. I am hoping to have my fiancee state side by the end of the month. But again, I only have secret, and my fiancee is from Ukraine.
