hey all. i'm about done completing the AOS package. however my wife doesnt meet the minimum 125% requirement. i work and both our incomes combined exceed the limit. however i am not authorized to work but i do anyways because i have a child to support. we both filed taxes jointly in 2005 and have the tax transcripts from last yr. my question is can i be a joint sponsor and have my wife be the primary sponsor even though i wrked without authorization? thx.

"I am not authorized to work but I do anyways..." so let's tell the people that control your life by your "short hairs" that you completely disregard the law...

i see. but since we filed jointly my earnings will show up on her transcripts for the interviewer to see anyways right.plus i thought the spouse of a USC is forgiven for working without authorization (plz correct me if im wrong)

wow im scared now. ok heres some background. i came in on f1 visa and got married january 05. we had a baby and i had to leave school due to lack of funds so my f1 expired. i started working to feed myself and my family and i filed taxes jointly with my wife last year. what do u guys advice me to do. oh and i entered the us in jan 04

* You are employed in the United States without USCIS authorization or you are no longer legally in the country (except through no fault of your own or for some technical reason). This rule does not apply to you if:

o You are the immediate relative of a U.S. citizen (parent, spouse, or unmarried child under 21 years old).

o Certain foreign medical graduates, international organization employees and family members.
