Hello, Everyone

I need a little help, I am petitioning for my fiance but I don't meet the affidavit of support money amount to bring him, so I am getting a Co-sponsor. My question is is there have to be a contract between me and the Co-sponsor in order for him to support my fiance? what I mean by contract is that if we need to filled out any document to specify the issue?

27 December 2013

I received email from USCIS- On December 27, 2013, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action.

30 December 2013

I received second email from USCIS- On December 30, 2013, we transferred your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, to your local USCIS Office for further processing.

31 December 2013

I received third email from USCIS- The I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN was transferred and is now being processed at a USCIS office.

2 January 2014

Received Transfer Notice hard copy. Case was transfer to Texas Service Center.

7 February 2014

Received email and text msg that I-130 was Approved!

13 February 2014

Received NOA2 hardcopy.

24 February 2014

Received email and text msg that our case was shipped to NVC.

22 April 2014

Received DS-261/AOS Bill and submitted DS-261.

23 April 2014

Payed AOS Bill.

02 May 2014

Received IV Bill and Payed IV Bill.

07 May 2014

Send IV Package.

25 June 2014

Send AOS package.

24 October 2014

Case completed at NVC.

03 November 2014

Received interview letter.

23 December 2014

Interview Date, got green paper sheet (221-g) and was told to submit another Affidavit of Support.

31 March 2015

Turned in the documents they ask for at the interview and told us to wait 60 days for a response.

05 August 2015

Case updated in CEAC from READY to AP.

CASE UPDATED: Aug 9, 10, 11, & 24. Sep 20

Timeline

The joint sponsor completes an I-134 affidavit of support of their own and you submit that along with your personal I-134.

If a joint sponsor is needed later at the adjustment of status phase, you both would complete the form I-864.

In both instances be sure that each of you includes all the required documents along with the affidavit of support forms.

The joint sponsor completes an I-134 affidavit of support of their own and you submit that along with your personal I-134.

If a joint sponsor is needed later at the adjustment of status phase, you both would complete the form I-864.

In both instances be sure that each of you includes all the required documents along with the affidavit of support forms.

Timeline

I would contact the Embassy and clarify with them. Reason being:-

Quote from Packet 3:-

"Affidavit of Support: An original copy of notarized I-134 Affidavit of Support (AOS) is required from the petitioner for each applicant. Affidavits from other individuals can be submitted but will not be given the same consideration as an AOS from the petitioner."

However, packet 4 didn't have the quote:-

" Evidence that Applicant will not become a Public Charge: Each applicant must bring evidence that he or she will be self-supporting OR that the petitioner will be able to support each applicant in the United States. An affidavit of support (I-134) accompanied by last three years of the petitioner’s tax returns and supporting W-2 form(s), IRS-issued proof of payment showing taxes were paid, current employment letter(s) and pay stubs & relevant bank statements."

Just send them an email with a scanned copy of NOA1 and make an inquiry at the email address DhakaIV@state.gov .

Don't worry, It shouldn't be a problem. Just clarify with them and make sure you keep your conversations, so, your fiance can take it with him for his interview.

Oh ok. Does this mean we don't need to prepare the co-sponsor's i-864 yet for the interview?

You don't need I-864 for the visa interview but need the I-134, it's different form. If you don't fulfill the requirement by yourself you will need your Co-sponsor to fill out another I-134.

You will need I-864 for Adjustment of Status.
