Hello family,

Just got some news about someone close to my fiance and I who is rumored to have gotten married to someone else in the Phils while still married to another in the US. I know this may seem redundant...but is it possible?? Can that actually happen in the phils? Please...anyone with any knowledge of this please advise asap. God Bless All...

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Okay let me clarify. My apologies for not giving you all more insight. I have an aunt who has somewhat emancipated from the family bond, she's married to an American man but has secretly been carrying on an online affair with a filipino man back where, the Phils. Family is now upset because of said rumors that she has come to the Phils to now marry this man in a civil ceremony. My question again, is this possible to do if she is still married? To answer any further questions..yes she knows that some of the family is aware of her affair but of course she does not care. Can you...will you please provide some insight. To the one who sent me a message in tagalog, salamat po.

I know, you can marry many wives if you're Muslim. But you can't marry if you are still married with someone. They will ask you a certification for no marriage. you're lucky if you have not reported your marriage to your American husband in Philippines. You may marry if that's the situation. You need to file divorce first before you can marry anyone AGAIN and if you are planning to petition your online-affair-alleged-fiance. If she intend to marry in Civil in Philippines and if she did not report her previous marriage. The civil marriage will be considered a sham or NULL and VOID. And yet, her previous husband can sue her for bigamy.

What she is planning is both illegal in the Phillipnes and the US. It's called the crime of bigamy.

Bigamy is illegal in the US, and a person can be prosecuted for committing bigamy. It doesn't matter if it is legal outside the US, she's a US citizen or LPR of the US so US laws apply to her.

I'm pretty sure it is illegal in the Phillipines since the Catholic church has a big influence on marriage laws there.

If a Filipina is married in the US and has no record of marriage in the Philippines, technically, she is still single in the Philippines. There is no documents in the Philippines that would say that she is married. She could still get a CENOMAR and marry a fellow filipino.

Legally, she is a bigamist. Even though there is no record of her US marriage in the Philippines, her US marriage is still valid in the Philippines.

If the family is not sure if she got married or not, they could ask for a copy of marriage certificate from NSO.

I'm certain that this happens every day.

If her current marriage in America was never reported to the Philippine Consulate serving her State then her CENOMAR would indicate "does not appear in our National Indices for Bride for the years xxxx-xxxx.

With a clean CENOMAR presented to the local City Hall, she could obtain a marriage licence in the PI.

Keep in mind that the USA does not have a central registry of marriages.

Additionally, should the USC file suit on the basis of bigamy, he is facing an uphill battle as the local civil courts will hardly recognize foreign documents. Further, the lowly county courts will not entertain a situation involving immigration as that is Federal jurisdiction.
