Visa Expiry date and Form I-130

Hi House,

I came into the US on a F-1 Visa and still in-status. My wife (USC) will be filing an adjustment of status for me but I am a little bit confused about the form I-130 and my F-1 VISA expiry date. We plan to submit our paper work by the end of August which coincides with the time my visa will expire (although I won't be finishing my program until May 2013, so that makes me to be instatus till I finish my masters). I am just afraid USCIS may think I am filing at that time becaus emy visa will be expiring that same month - which is just a mere coincidence. Do you all think it wise for me to file that same month, or wait a little bit further?

Also,I need help with the following question numbers on the form I-130 pls.

#14 - Date auhorized stay will expire, or will expire, as shown on Form I-94 or I-95 : There is no expiry date on my I-94. The only thing they wrote was "D/S". Do you thik I should just put the date they expect me to complete my program as stated on my form I-20?

#15 - Name and address of present Employer - Is it my present employer or my wife's (USC)employer?

#18 - Address where relative intend to stay - since I am already in the US, should we just leave it blank or just write the address where we both live now?

#19 - Your relative's address abroad - Should we just write my last address in my home country?

#20 - If filling for husband/wife, give address at which you lived together - We are currently living together,and I dont know if I should put our present address.

September 2010 - Came into the US on a F-1 Visa....still in-status.

October 2010 - Met wife - USC.

2011 - We realized we were already bf and gf....no formal toasting...lol.

January 2012 - Proposed to my wife.

June 2012 - Got married.

August 29 2012 - Mailed AOS packet to Chicago Lockbox. (Day 0)

August 31 2012 - AOS packet delivered. (Day 3)

Sept. 3 2012 - Received 4 emails/texts notification for NOA1 @ 7:59am PST (Day 6)

Sept. 8 2012 - Received hard copies of NOA1 in the mail. (Day 11)

Sept. 10 2012 - Biometrics appointment notice received in the mail. Scheduled for September 25. (Day 13)

Sept. 11 2012 - Successful early walk-in for biometrics appointment. (Day 14)[/left]

#14 - Simply enter "D/S".

#15 - Questions on the right side are regarding the foreign spouse, the left the petitioning USC / LPR. That question is on the right, so is asking about the foreign relative (i.e. you).

#18 - The current address you reside at together.

#19 - Enter "None" if you now have no permanent address outside of the US (and it sounds like you don't). USCIS will still obtain your "old" (foreign) address on the G-325A that you have to fill in.

#20 - Current address (same as #18).

It makes no difference when you file; USCIS will not care if it's now or in six months or in twelve months. They only care that you have the standing required to make the application. In the case of being the spouse of a USC, since overstay (if incurred) is forgiven then you can apply at any point, both in and out of status.

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Timeline

Your visa doesnt matter, since its only there for entering purposes and proof, that you entered the us legally. Your I-20 determinds your length of stay so they wont say anything

Day 00 - 01/02/2013 sent AOS package via USPS

Day 02 - 01/04/2013 package arrived in the am *patiently waiting for more*

Day 05 - 01/07/2013 received text messages for all 4 forms

Day 06 - 01/08/2013 checks been cashed

Day 08 - 01/10/2013 received NOAs for all four forms

Day 12 - 01/14/2013 received appointment letter for biometrics on 02/01/2013 but completed biometrics the same day

Day 27 - 01/29/2013 received email that our case is ready to be scheduled for an Interview :)

Day 29 - 01/31/2013 received an email that our Interview will be on March 6 2013!!!!!!!!!

Day 33 - 02/04/2013 received hardcopy of interview letter

Day 62 - 03/05/2013 EAD/AP approved

Day 63 - 03/06/2013 scheduled interview appointment - APPROVED

Day 66 - 03/09/2013 I130 & I485 Approval noitces arrived in the mail

Day 70 - 03/13/2013 EAD/ AP combo card arrives in the mail

Day 71 - 03/14/2013 Greencard arrives yay!!!
