How do you know that? Sorry, I am just nervous about making a mistake.

Also I have a serving job that I am hoping to continue with while I am waiting for my new EAD. I know this is a bit of a risk but I feel like they overlook this with spouses waiting for EADs. I was also just wondering if I should outwardly state this on my I485 or just leave that blank?

Your I-485 was denied, but the underlying petition is still good. Include your K visa etc (though it is better if you can find the NOA2 from the I-129F). Be truthful in your paperwork.

I am really sorry for your situation, I am just trying to answer factually and dispassionately to get the info out there, but at least I will reiterate that your situation is total BS and I really think someone (at London embassy) should answer for it.

Also, request expedite on the new EAD based on USCIS error (well, in that case it is based on consular error, but related).

So do I! but I am not going to try and chase up a guilty party at the state department who didn't print on my J1 that I was subject to the HRR.

I dont mind reapplying, just as long as it goes smoothly! bloody farce!

So I intend to keep my serving job while I am waiting for my second EAD. But do you think I should just write on the I485 that they are still my current employer? Is there any way to know what the USCIS will do when they read this?

Illegal work is not a bar to approving AOS if you are the spouse of a USC. Tell the truth about the illegal work, and request expedited EAD.
