Does my wife need a local Police clearance certificate?

Can someone help me here? This is urgent because I am submitting DS-230 and other documents pretty soon and I need some help with PCC.

My wife just got her passport (for the first time) few days ago. Does she need a local police clearance certificate to go along with DS-230? I have read somewhere that If the passport was issued within last 6 months it is not necessary. Will I get a rfe if I do not submit local police clearance certificate with DS-230? Can I just submit a letter with DS-230 explaining why she does not need a local police clearance certificate?

I know that we need to submit the PCC from passport office to VFS Post prior to interview?

02/08/12 - I-130 sent to Chicago Lockbox.

02/09/12 - NOA1 received and processing at Vermont.

07/02/12 - NOA2 announced on status check.

07/09/12 - NVC received case.

07/27/12 - NVC Case Number and IIN Issued.

07/27/12 - Sent DS-3032 via email.

07/31/12 - AOS bill received via email, paid online.

08/01/12 - AOS marked paid, Mailed AOS packet overnight.

08/06/12 - Assigned as Agent, IV Fee bill received via email, paid online.

08/07/12 - IV Fee marked paid, Mailed IV packet overnight.

08/07/12 - AOS accepted.

08/13/12 - Case completed

09/14/12 - Assigned Interview date.

10/18/12 - Interview Date

If she has "BMBxxxxxxxxxx" case number so for Mumbai consulate you may skip PCC at NVC. They will complete your case with a checklist to bring PCC (issued by Passport Office only) at the time of your interview. No need to delay sending DS-230 for PCC specially for Mumbai consulate applicants.

Let me know if your wife had to get local police clearance certificate to ge pcc from passport office. my wife's passport was issued 3 months ago.

I didn't give PCC with DS-230 at NVC and my case is complete. But you have let NVC know that you will bring it to Mumbai interview. I made Cover sheet of my own for my husband, he putted on top after the coversheet provide by NVC for DS230.

This is how I made my husband's coversheet for DS-230 Package:

Preference Category: CR1 – SPOUSE OF UNITED STATES CITIZEN

Submitting Application for (CR-1) Immigrant Visa DS-230 for NVC

Beneficiary's Name :

• DS-230 Part 1 completed and signed by beneficiary

• DS-230 Part 2 completed by beneficiary – unsigned, as of yet, per instructions

• Certified Marriage Certificate

After they review Ds-230 Package, You will get checklist from NVC later : (this is false checklist) but just call NVC and confirm with them.

______10 - PASSPORT POLICE CERTIFICATE:____________________________

Indian Police Clearance Certificates should be obtained as follows:

• All Indian IV applicants aged 16 and above, residing in India, should obtain police

certificates from the local Passport Office.

• Indian passport holders applying for visas outside India should obtain a statement from their

local embassy or consulate confirming they have no criminal record.

• Non-Indian IV applicants residing in India should obtain police certificates from the District

Police Station serving their area of residence.

• Indian police certificates are not available for foreign (non-Indian) applicants applying

outside India.

At Mumbai Interview they need police certificates from the local Passport Office, not from local police station.

Even if the passport is new, they still need to get PCC from passport office.

I am sure because My case was completed earlier this week without PCC. I have talked to many operators at NVC and have received same response. If you have an interview at Mumbai Consulate, you only need a PCC from a passport office.

I can also confirm that you only have to have the passport clearance and not the local police clearance as long as you are submitting documents at Mumbai. Each consulate handles things differently. We just did our PCC last week because they had expedited our interview date and I even asked that if we don't get the clearance in time to submit the paperwork to VFS can we submit it at the interview and they said yes.
