Ok here is my question to everyone. If lets say one's K-3 approved and the I-130 is still pending. Can the person come to USA and without the approval for I-130 file for AOS or one has to wait for I-130 to get approved.

And lets say If a person has a K-3 visa in hand and comes back to the States and if the I-130 gets approved, can the person go for Consular processing and AOS in the US (both at same times). Just to see where ever he can get an interview first?!

If a person comes back for Consular processing for cr1-ir1 to the country and goes for Consular processing, if put on Admin processing can the person return to the US on his K-3 or do they cancel it?!

I would be much obliged for a response from anyone who has any knowledge regarding this.

That's the point of the K3 actually, to be able to sit in the US and wait on the I-130 to be approved so you can apply for Aos.

I agree with what Reba said, once the K3 is approved you can choose to go back for the CR/IR1 at the consulate OR pursue AOS in the U.S., there would be no reason to do both even if you could. Also I'm not sure about the administrative review part of your question, sorry!

Many opt for returning to the consulate for the CR/IR visa. It is one of two options to gain immigrant status. There are many reference to these options on the USCIS website. Doubt very much that any issue will be made because you opt for consular processing of an immigrant visa over the option to AOS state side with the K-3.

ok I guess when I get the K-3 i can ask the CO that if I opt to come back for Ir-1? is there a possibilty of admin processing again and if so returning back to the US during Admin processing...

Does anyone know if someone had to go through this??
