i130 k-3 visa process

Timeline

Ive tried doing some re-search and spoke to many lawyers however am always getting mixed responses. If anyone knows or has gone through this please answere :)

My husband came here when he was 13, illegaly, with his family. He has resided in the US since, and is now over the age of 18. We had a child, and decided to get married and start his processing. Will he be able to get his visa although he is not legally allowed in this country? Its been 4 months and we havent heard a approved response for the i130 and are getting nervous, someone he knows did this process last year and the whole i130 and visa process took 6 months, is it normal to take this long just for the petition?

I dont have a clue about the fact that he was here prior as an illegal as the affect it will have but 4 months with VSC is normal they are running slow in Vermont on NOAs. I dont know how your friend got threw in 6 months I guess it could happen that would be great but it is not the norm. Check out the link at the top of the page the Guides link and it will tell you the time frame for the process I think it is estmated to be 9 months for the entire 130 visa process.. Yes, your current wait time at USCIS is normal, it will be around 5 months

Then another 2 months at NVC

Then the interview where he will need to interview in MX and will be denied for illegal presence. You will then have to option to submit a waiver as to why you would suffer extreme hardship if he was not returned to the US - do not attempt this on your own, hire a lawyer for it

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
