Belinda, I never pursued Child Support; OCSE did. NY says 25% of gross for 2 children. She told me in 2006 she was making 35k. This is unverified. The Support was never ordered by virtue of her winning dismissal on the date of Second Appearance, fraudulently. She VOIPed into the scheduled second appearance, spelling out under oath her address in the old country, from which she was granted Asylum 3 years prior. She testified that never had legal status, never worked, and is now under 10y bar. OCSE prosecutor said "nothing further", and Magistrate said "case dismissed".

I did go to Family Court in my borough next day and filed for Order of Protection and TCS, and made sworn deposition to what she pulled yesterday at the other Court, and threats she made if I ever do anything resulting in "Federal Warrant", as she put it. I was not able to effect service - and my Family Court claim was dismissed 8 months later

So as far as the Courts are concerned she is not in the US?

I then appeared every year, called by OCSE as a witness - and every year OCSE would tell Magistrate they couldn't serve her using LexisNexis. Every year it was dismissed again, despite me saying "May I say something?" And as soon as I explain to Magistrate that they've been duped on this very speakerphone in 2006, and I'm requesting Order of Protection because of all threats I'm getting - the Magistrate says: make an appointment at OCSE office. Next case!

Eventually, I received letter earlier this year that OCSE was about to close her file. They haven't called me to appear last couple of years since I asked my caseworker for DV exemption. What was my better move?

Singledad a non profit organization won't help you out with police certificate and divorce papers because they don't do that at all.YOU must take care of these things before you go to see them.Get police certificate from July 2077 to present (every place you lived more than six months).If I was in your shoes I would file for divorce NOW and then you will solve this problem.

singleddad you must prove extreme cruelty(mental abuse or physical abuse) tell them how she humiliated you or your kids,, manipulated,neglected,insulted you,dominated and controlled you. Vawa DO NOT CONSIDER mental anguish associated with marital difficulties, infidelity, separation or abandonment.The Vawa adjudicators want to know what were the words, names used, what tone of voice was used, how did the incident started and end, What did you do in response? How did you feel as a result of her actions?. Explain how did your life change? how were you affected by the abuse? what did you do to deal with the abuse? You must provide as much detail about of the extreme cruelty possible. If your family or any friend knew about the abuse that your kids or you suffered in 2002 or 2003 ask them to write affidavits stating what they heard from you in that time or what they witnessed. Vawa Unit does not consider any abuse suffered after the separation, you must prove the abuse suffered when LIVING TOGETHER. Keep in mind that "mean" treatment is not CRUELTY. You must prove extreme cruelty.

2-Filing for divorce now can prove you divorced in 2012...did you get it?

3-It's hard to tell you, because sometimes they cooperate sometimes they don't.But big non profit organization may get the answer before filling form I-360.

Another thing one of your child suffers impaired social interaction and communication(autism) right? maybe you can have your Vawa expedite.

Wow! Thank you!! He just had neurological, psychiatric, psychological and psychosocial. I was present during all, and I expect very grim reports.

Also, extreme abuse discussion is very interesting. I thought Abuser's 13-months sentence was key, as well as pictures taken by ACS and their 3 findings of "indicated". But also her games keeping my name off her Immigration record and Birth Certificates, 3 copies of her police reports against me that she later tangled in my face, her changing stories to Social Workers recorded in ACS reports I obtained by luck - all this shows totality of cruelty. I just don't agree that her threats since moving out should not be on mine and my witnesses' affidavits

I am going a little bit off topic here ok. I understand that many people are curious about how he survives in USA, others get nasty because he is living here without status. What's the difference between a dedicated mother, without status, unemployed, trying to survive and giving the best care for their children and him? ZERO..NADA... There are hundreds of US Citizens, green card holders dumping their newborn in garbage bags, killing their children, and despite he is an illegal alien he is taking care of two kids for nine/ten years alone.We need to stop judging people because their status and evaluate them because of their actions.We need to see others with some compassion.Do I care my tax help him to feed his kid? NOT AT ALL. There is no difference between my kids and his kids.He is not a drug addict, a lazy man, a vagabond,an alcoholic, he is just a man raising his kids ,struggling to survive.He gave his life for his children, when the mother walked away. Let's keep here talking about his Vawa case and not about his private life. If someone here is offended because of his status I would recommend this person to find God for just one minute... we need just one minute to know the true meaning of compassion and solidarity.
