Obtain proof of Spouse's status

There is only one question in this topic (and a very common one for self-petitioners): how to obtain proof of spouse's status, required for VSC filing?

I'm afraid to say, no direct answer so far. I've seen someone on this forum mention Citizenship Ceremonies somewhere, but poster seemed a little tentative - there was no explanation...

Does anyone know for sure: can someone authorized to access SAVE print the page?

There are a number of private background check companies that are designated agents under the SAVE system, and have access to the SAVE database. Hire one of these companies to run a background check for you.

You don't know whether or not you're married. You don't know whether or not your wife/exwife is LPR, or USC. You don't want to hire a PI to figure it out but you do want to file VAWA?

Spouse's lawfirm is not allowed to hand out confidential info to anyone else than her. Anything both you and her signed together, or anything she authorized you to see/use, you can obtain legally unless there are specific state laws about it.

Interesting. Do they have capability to print page, which will constitute solid proof to VCS? How much would it be?

They'll give you a copy of the report. That's what you're paying them for.

Most background check companies don't advertise their rates. You have to contact them, tell them what information you want them to look for, and they'll give you a quote. Since the job is done entirely from a chair in front of a computer screen they will charge a lot less than a PI would charge. Considering that prospective employers and landlords use these services I'd guess they're not very expensive.

USCIS WEB SITE is not often updated, but the immigration records are completely updated. I answered your question before and I am going to repeat again, JUST FOR VAWA CASES your lawyer may request that USCIS search its records to confirm the status of the abuser.

Yeah that website is a joke. My wife's I-130 still shows pending. She's been here 3+ years.

Another "joke": NYC Vital Records website says it takes 5 weeks to process corrections, such as adding father's name on Birth Certificates. (B.C. are required to be attached to VAWA appl.)

I have 2005 Court order, saying B.C.'s may be issued to Father. Also, 2005 order of custody. However, the vital records office may still insist that mother's signiture is required on correction appl.! Goes back to the point that Mother's Rights have never been officially terminated

Can my pro-bono lawyer appeal to any court for spouse's immigration record, or at least for the answer on whether I'm eligible to apply based on spouse's status? I doubt such may be obtained before my VAWA application goes in... I'm really at a loss of how to obtain the PROOF required to submit self-petition

Why not ask your Lawyer what they can and can not do?

Can you not go to the court where the mothers right were supposedly taken away and ask for a copy of the paperwork, it should be public record, if not can't childrens services help you with it?

First Family Court (neglect) decision 2004 was: 1)case dismissed against Mother; 2)children to be discharged to Father (from foster care) under ACS supervision to ensure....

Second Family Court decision 2005 was: Final Order of Custody to Father on Mother's default. I also asked the Judge, and he issued separate order:

"IT IS ORDERED that Court Records show that Petitioner and Respondent were married on x/xx/2000 and continue to be married at the present time; XY and ZY are children of that marriage; birth certificates may be issued to father."

Unfortunately, no Termination of Mother's rights have ever been brought - despite ACS still having open case# in her name from 2002. She just declared then and kept repeating later (but never in court) that she doesn't want any responsibility for the children. So responsibility all these years was solely mine, and she also fraudulently caused the Child Support case to be dismissed.

Is the order language above ENOUGH to make Vitals add Father's name?
