Obtain proof of Spouse's status

Under VAWA, it is required of Self-Petitioner to attach PROOF of estranged spouse's LPR or USC status. I know spouse's name, D.O.B., SSN, and A#. But A# is not enough to submit, as federal computers might not have been updated in years in reference to spouse's LPR adjustment or USC.

Please don't advise to hire PI, as that's expensive. There must be ways of finding at least Citizenship Ceremonies records, either by venue (mine would be Garden City, NY), or via Citizenship Court? Also, do not suggest Ancestry.com who would carry old records, not 2008-2012 Citizenship data that I need.

I know spouse's pro-bono Legal firm: only because I applied for their services in 2011, and received letter saying they can't represent me "due to adversarial conflict"! But how knowing spouse's law firm can help me obtain info?

Spouse could never handle a car, so DMV would likely have nothing. Spouse has been hiding from OCSE since "first appearance" in March 2006 at Support Court in Manhattan, but then achieving dismissal in May 2006 trial by simply calling in and falsely claiming under oath to be barred from US for 10 years. OSCE closed Support case!! NY divorce records are blank for both spouses' names.

Can my pro-bono lawyer appeal to any court for spouse's immigration record, or at least for the answer on whether I'm eligible to apply based on spouse's status? I doubt such may be obtained before my VAWA application goes in... I'm really at a loss of how to obtain the PROOF required to submit self-petition

You really don't have a right to her info, only info that could be a part of any filing done on your behalf. I am sure there is more than one pro-bono attorney out there. Put in some effort and find another.

you misunderstood. I've only mentioned that letter to explain how I stumbled upon the fact that my spouse:

1. is apparently that firm's client (as I wouldn't have adversarial conflict with anyone else)

2. can be assumed to still be around the city we used to be living together in

3. was likely a client on Citizenship process (although might be on other issues, one never knows)

I don't expect that my pro-bono attorney, who I haven't engaged yet, would get any info from spouse's attorney. I also don't expect any court to order any acknowledgement by my spouse's firm. I wonder, however, if OCSE who say they can't serve my spouse Support Summons, could try to serve it thru that firm?

In any case, this is not about spouse's lawyer. I really need to find a way to check Citizenship Ceremonies in Garden City, NY 2008-2012 (hopefully, alphabetical) to maybe discover the name mentioned. Or is there any other source, accessable by me or my future attorney?

this was a valid comment. I'd like to step back and re-iterate: the issue is straight-forward and likely applies to thousands of families

1. I have one proof required for self-petition: nationwide divorce records come empty, we're still married.

2. However, spouse moved out; and no one knows address or place of employment - as spouse successfully avoids service to appear in Support Court.

3. Thus, obtaining copy of spouse's GC or Nat.Certificate or Passport is impossible. How can I fulfil second requirement of filing: attach proof of spouse's LPR or USC?

1. You assume you are still married based upon one website. She could have divorced you anywhere in the world.

2. If the child support office with their resources to check financial records and employment databases (employee new hire and such), credit records, cell phone records, etc. then

3. YOU can't, find someone who has the resources and knowledge to find her, if she is still in the US and if she ever obtained a green card.

So if I just submit spouse's A# and ask VSC to punch it - I'm afraid the Immigration Officer will not see spouse's LPR, which should've been on record years ago. Apparently, they're too sloppy updating those entries - and that may be the main reason behind their requirement that the self-petitioner attaches proof! And like I've noted before - how do you obtain proof, when the Offender is on the run?

"their" database? Who's database? The SAVE database was updated that I was an LPR as soon as I became an LPR.

All you can do is try, if you fail, you fail and return to your home country.

I am pretty sure they have updated databases. I have already obtained 3 FBI clearances for myself this past year for school and work and I am recent LPR.. thats not why they ask for a copy of your GC when you file, they are just making sure you have a copy of your GC because you are required to replace it if you lose it, thats my guess. Goodluck, but I think its very unlikely you'll obtain this info (at least legally)

I received my 10-year greencard (ROC) in 3 months with no interview (March-June 2013)

My husband returned from deployment 06/20/2013

My naturalization journey took 4 months (April-August 2014)

I became a US citizen on 08/01/2014

Received passport in 3 weeks (regular processing)

You are making a lot of assumptions here. You assume you are still married, she obtained LPR status, and she still lives in the US. You have proof of none of this. Since the children are receiving state benefits, which any child support she paid would be applied to, nope it won't go to you it will go to repay the state for the children's benefits, I am sure the state is looking rather hard for her. Given the resources they have, if the state can't find her I doubt you can. I don't know if they have access to any immigration database.

Why don't you just give up trying to obtain legal status, which would be an extreme long-shot even if you obtained the information, and move on.
