Seeking help regarding employment in the U.S!?

Hello guys!

I have been having some major issues with finding the right information about getting a temporary nonimmigrant employment visa in the U.S. Somebody told me to get the H1B visa, but I don't fully understand what that's about and I would appreciate it if you could help me. Another one that's being tossed around a lot is the I-765, but I don't know the deal about that one. I already have an employer lined up ready to give me a job (I worked with him last year on a J-1 visa), I have a place to stay so the only thing that's kicking my *** right now is this..

Is a petition the best way to do this or is it something else. What do you guys think? Again this is just for work...

What visa you get will depend on what type of job you will be doing.

Usually, the employer's lawyer will deal with this.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Work visas aren't typically something you do yourself, your employer will take care of all of thise

As other said, employer gets visa for you - you hardly do anything. H-1B visas are at this unavailable until October 2013 since cap level has been reached.

Actually I do have a job offer ready. So what exactly does my employer have to do? And if the H1B visas are unavailable, what about the H2B and what can this type of visa do for me? Can I apply for that or should I stick with the I-765?

I'll be working as a night housekeeper at a hotel.

the firm you wish to work for - they have legal representation on work visas - is best that THAT firm contact it's legal representation.

So what you're saying is that I get their lawyers to do it for me? What about the I-765 form or H2B?

H2B is seasonal. Meaning you are here for short period of time and then return home. Is that what you want? Or are you wanting to move to the US for the long term? If long term, your employer has to prove they cannot find a suitable employee already int he US and file for you and pay the fees, etc.

H2B is seasonal. Meaning you are here for short period of time and then return home. Is that what you want? Or are you wanting to move to the US for the long term? If long term, your employer has to prove they cannot find a suitable employee already int he US and file for you and pay the fees, etc.

Well actually what I'm thinking about is staying there for a year or so, not really long term. I understand that it's seasonal, but can it be prolonged for a year? - I'll be working as a night housekeeper, would that qualify?

What about the I-765? What would that do?

You do not do anything, it is as others have been said down to your Employer and their Lawyer which visa they deem suitable and which they wish to apply for.

So talk to the Lawyer handling the case, I would not hold my breath btw.

A job of night housekeeping would only qualify for a H2B if this job is at one of the seasonal resorts that only operates on a seasonal basis. The resort or hotel would not be advertising the job as a night housekeeper, but rather has seasonal employees to do no classified task work at minimum pay.

You have no chance of coming to the US to be a night housekeeper. This job is unskilled. There are lots of Americans without jobs. Why would the US government allow you to come in to take a job that may go to an unemployed American? It does not make sense to give jobs to foreigners when your own citizens need jobs.

If your employer wants to hire you, have them go through the certification process. The employer must certify that no US citizen or resident is available for the job and that's why the floor needs to hire a foreign citizen. The employer must obtain a department of labor certification before he can hire you. An impossibility for an unskilled job.

However in this case it comes across that the Employer is clueless as to the issues and costs involved. So is most unlikely to happen.

Up at Mammoth, I've met a couple of foreign ski instructors. They were highly skilled. The housekeeping staff were mainly unskilled. I can imagine why the US employer can justify hiring skilled foreign ski instructors, but not unskilled foreign housekeepers.

Because they pay them well below minimum wage and get to deduct room & board as well. Probably tax credits too.
