Has anyone recently filed for a I-131 after you have received the Conditional 2 year GC?

When we had Biometrics done today the posting on the wall said that the I-131 requires Biometrics.

If she just had Biometrics done for the GC and EAD will Yuan have to have another round of them for the 2 year I-131? It would be really great if we could just have the I-131 delivered to either the India or Chinese Consulate. It would save the trouble of a 30+ hour of travel back to Buffalo for 15 minutes of paperwork.

Thank-you in advance for your help.

Are you applying the I-131 for AP or a re-entry permit? Since you have the GC I would assume you are applying for a re-entry permit as AP is no longer needed. The re-entry permit will be done in the US before you leave. You most likely will need another bio appointment but it may be close enough to the AOS to not require one. I guess you will know when you receive the letter.

Good Luck,

Dave.

I am confused. Your timeline shows you just filed the I-485 and I-131(AP) but not the I-765(EAD). You just did biometrics today for the I-485 and I-765? That would mean you do not have the green card yet. You should put in your timeline that you filed the I-765 too.

There are no biometrics taken for the I-131, just the I-485 and I-765.

The EAD and AP are used to work and re-enter the US while waiting for the I-485 green card approval. Once you have the green card, the EAD and AP are invalid and no longer needed. You will then only need the green card to work and re-enter the US when traveling. You will not be getting a 2 year EAD/AP that needs to be renewed in 2 years. The green card you will receive will expire in 2 years, and in the 90 days before it expires, you must file to remove conditions and then receive a 10 year card. See the guides here on VJ for lifting conditions.

I am not sure what you mean by having the AP(I-131) delivered to a consulate. If you leave the US, you must have the AP or green card in hand before you leave, or your AOS will be deemed abandoned and you will have to file for a spousal visa to get them back in the US.
