I was planning on including affidavits from my father and a coworker, but I really didn't want to inconvenience them by having them sign in front of a notary public.

  • Has anyone here successfully removed conditions with affidavits that weren't notarized?
  • How important do you think notarizing is?
  • 08/28/08------ Met online
  • 06/07-06/23/09 Met in the Phils
  • 09/09-12/09--- 4 tries to get passport
  • 12/17/09------ Passport ACCEPTED!
  • 02/02/10------ Passport received

  • 12/19/09------ USCIS: I-129F sent
  • 12/23/09------ USCIS: NOA1 (case received)
  • 03/18/10------ USCIS: NOA2 ACCEPTED! (85 days)
  • 03/24/10------ NVC: received case
  • 03/29/10------ NVC: sent case to USEM
  • 04/14-04/15/10 USEM: medical exam PASSED!
  • 04/27/10------ USEM: visa APPROVED! (125 days)
  • 05/04/10------ USEM: visa received
  • 05/29-06/14/10 2nd trip to the Phils!
  • 06/14/10------ POE: Minneapolis

  • 07/24/13------ ROC: USCIS letter received - case still pending, transferred to Newark Field Office
  • 08/12/13------ ROC: I-551 stamp on passport at Newark
  • 08/23/13------ ROC: USCIS letter received – interview scheduled
  • 10/08/13------ ROC: USCIS interview; APPROVED! (420 days)

It is not a must. If it is a lot a hassle you dont need to pursue that option. Affidavits are important as additional evidence but not as important as other evidence you can present such as photos, joint bank accounts, bills, etc. the gamut of papers that are inherent to a relationship.

I sent an affidavit that was not notarized, and everything went just fine.

USCIS used to be real in to notarization, but they really don't care anymore, I think. I've never notarized anything I've ever sent them, and everything has been very smooth.

Funnily enough, this is one of the most common questions in this forum.

Needless to say, notarization is likely a waste, since 1.) USCIS doesn't care, and 2.) Affidavits are only support information.

Married: 07-03-09

I-130 filed: 08-11-09

NOA1: 09-04-09

NOA2: 10-01-09

NVC received: 10-14-09

Opted In to Electronic Processing: 10-19-09

Case complete @ NVC: 11-13-09

Interview assigned: 01-22-10 (70 days between case complete and interview assignment)

Medical in Vancouver: 01-28-10

Interview @ Montreal: 03-05-10 -- APPROVED!

POE @ Blaine (Pacific Highway): 03-10-10

3000 mile drive from Vancouver to DC: 03-10-10 to 3-12-10

Green card received: 04-02-10

Karen_and_Jay, we didn't submit any affidavits for my husband's ROC, and he got approved. I am thinking if you have all your documentation that shows proof of your joint financial assets and proof of your joint residence, you should be fine.

This is incorrect. Notarization is not required.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

Before our ROC time, I asked a very sharp immigration attorney about affidavits. He said that affidavits aren't necessary at all unless the other evidence is thin.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
