Hello All,

I m having a situation and would love you folks to shed some light on it. After all the nine yard process I have done to bring my ex wife, after one year she refused to live in the US “being spoiled by her family, this great country is too hard for her" . she got her green card in 2009. In 2010 she went back for a visit to the original country but she did not come back. Last time I saw her was in the court in Oct 2011 when I filed for divorce.

To make the story short, I got divorced overseas in March 2012. We no longer contact each other. Here are my questions, what I am supposed to do in this case? Do I have to contact the immigration service? Is there a procedure to withdraw my sponsorship?

Did your ex-wife voluntarily surrender her green card at the time of departure? If so then immigration already knows her status.

If your wife had a conditional green card and you did not remove the condition on it, then it has expired. She no longer has a valid green card. You're off the hook.

she did not surrender her condition green card to immigration office before departing the country.

Thank you folks, i was worrying that this will affect my tax return and credit score or something.

now I can enjoy a real good vacation, who wants to go to the Bahamas? :-)

However, if she's been out of the US for more than a year without first obtaining a reentry permit then she's abandoned her residency. That would terminate the affidavit of support.

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

She could theoretically have self-petitioned to remove conditions based on divorce, and he wouldn't necessarily know anything about it.

However, if she's been out of the US for more than a year without first obtaining a reentry permit then she's abandoned her residency. That would terminate the affidavit of support.

She got her conditional green card in 2009. She left the US in 2010 and did not come back. The OP divorced her in Oct 2011 overseas.

Assuming that she got her conditional green card in Q4 of 2009 and she has been oversea, how would she have self-petitioned to remove the condition after the divorce in Oct 2011 from outside the US?

Even if she managed to come back to the US in 2012 before the 2 years expiration date, she cannot remove the condition based on the facts that her green card became invalid upon divorce and she illegally used it to enter the US.

she was issued a green card.

With that green card, are residency requirements.

IF SHE FAILS to maintain the residency requirements, then your sponsership is no longer in effect.

For example, if she went back 'home' whilst the green card was 'still current' and has not return to USA 6 to 9 months after,

then she's abandoned her residency. Yer off the hook.
