Our NOA1 date is 5/24/12 and my timeline says, "your I129f may be adjudicated between November 12, 2012 and November 17, 2012", assuming no RFE. Unfortunately, her mother told her she needs to get a job and she tells me that every job is a contract for at least a year in the Philippines. And if you break that contract, you can be in some big trouble and possibly jail time. My questions are, is this true? And if so, if I get the NOA2 around November/December, will we be able to stretch everything out until August 2013?

I think I read that you can interview up to 90 days after NOA2 you can travel to USA within 6 months of approval. That would take it to about August if what i read is true. Please help thank you!

lol so funny that some people will say such thing just try to rush you...sorry hon. i'm not from the philippines. but i was born there and my family are from there. some company do required contract some don't. but i never heard of someone will be jailed for not finishing a job contract. :bonk::rofl: (please someone correct me if i'm wrong..lol)

My wife is from the Philippines and I never heard of someone being jailed for not finishing a job contract.

Having working in the Philippines and employeed a number of contract workers, the norm is a 6 month contract. The 6 month contract can then be renewed 3 more times, up to 2 years total. I don't believe I've ever heard of anyone being jailed. The preference is that the employee work the full 6 months, but there are times that's not possible. Some contracts may go longer, but all I've ever seen are 6 months.

However, if she tells them during the interview that she won't work a full 6 months (and 6 months should be easily doable in your timeframe) or that she would ONLY work 6 months it will make it more difficult to get the job. I would recommend she avoid any discussion of the visa application. If she does leave early, she won't go to jail, but it could leave an unhappy employer.

Not sting its the right thing to do, just up and quit on an employer... But if he WERE to be working when she got approved, and IF they told her she has to finish her contract, how would they deal with her just not showing up one day because she got on a plane to the US? In short... They would forget about her.

My Mother-in-law and father-in-law also like if I can help out, but they appreciate it and show their appreciation to me. My wife is normally an overseas filipino worker, but that is not possible now in our process. Good luck to you.

You can always ask the embassy for an extension on the visa expiration. Give the true reason for an extension and chances are it will be granted.

Why is this? It won't make any difference in the states.. May I ask what type of work? I guess if she is a nurse this may help, but not McDonalds. And Mcdo is a good job in the phils..

I wouldn't worry about it at all but I would find out the reasoning behind her mother's request. What kind of job would she be applying for? It sounds like her parents aren't ready for their daughter to leave to me.

I never heard about jail time once you didnt finish the contract.. As simple as this she can apply work.. Then once the visa is ready...resign.. Besides its hard to find job here in the philippines even college graduate having hard time. She will be ok even she find a job and leave early..

There's no contract for working in the Philippines beyond normal. If she is a model, domestic helper, on skill basis worker, consultant or temporary, contract can be draw but it's not one year, contract depends upon agreement of both parties.

So, I might agree to some posters here, something fishy.
