Hi

I came to the us 3 years ago with an F1 visa, i studied at a community college and i'm about to start my last 2 years at a university. the semester is starting august 27th. I met my fiance in January 2012 and we're getting married next week.

I have been thinking for a while about what to do. My 2 choices :

1.File for AOS and attend university starting august 27th. and still pay international tuition OR

2.File for AOS and NOT attend university but wait until Spring 2012 to continue with resident tuition

i obviously tend to option 2, but i don't know how this would affect my F1(do i lose F1 status as soon as i submit AOS papers?) status, and also whether it would look suspicious at the interview.

i would appreciate your help :)

Hey am just putting in my opinion coz i came into the country as an F-1 just like you, If you have the money then its fine to take the first option, secondly you can opt and take the second option which saves you money coz i know how expensive it is i have been there so i know. Also i was wondering did you take summer classes or you were at summer break because international student can take one semister off without going to school in a year so if you havent used yours i think taking that one break off school will be great since you have 4 free months to marry and apply with your status still active.

If you decide to file and adjust without attending school your DSO has the will to terminate it. If they do not terminate your F-1 it will be terminated automatically by USCIS since thier system is set up that one. My advice is to inform your DSO of your decision of adjustment when you file and you receive your first NOA1 you take it to her office they will terminate your F-1 but you can still take classes with in state tution.

I did that after i applied i went and saw my DSO and she asked if i wanted it terminated or left for 60days told her i still wanted to go to school so she terminated it and i had a waiver which allows me to pay in state tution very cheap and you can take only one class. This way when you go in for your interview the office will see you didnt abandon school completely . Got me

Are you sure you qualify for resident tuition after only 6 months? The university I attended would only allow you to switch from out-of-state tuition to in-state after one year of residence and the income coming from a local source. Btw out-of-state was the same as international. Also, you will be putting your future in the hands of the government while you wait for the I-485 to be approved. What happens if you are not approved until late January or even February? You may be taking an entire year off just to pay resident tuition. Also, the resident clock may not start until you are approved for the GC which might put resident tuition into January or February 2014. I would check on all this and make the decision based on what works best for your plans and you life.

I am in the same situation and I picked 1.

Already paid my international tuition for Fall 2012 since I won't be able to get my GC by the end of this month :(

and School is still the first priority in my life right now..so.. I would suggest you to do the same only if it's not too hard for you to come up with that kind of money..

I am also wondering the same thing, Am I considered in-state student as soon as I get my GC? I already been in California for 5 years..

Im in the same boat, but i will choose option 2. Not financially but bc im moving to the other side of the country after the next semester. Also my current school doesnt allow me to take online classes, when im not present on campus. And my cali colleges said i can only apply for a transfer after having enough units (which i will have after this semester, but then its too late to apply for the spring semester

I was told that when im married and my husband has lived in the state of california for a certain amount of time (he was born and raised in san diego and still lives there) that i can adapt his status and pay in-state tuition. I guess every state is different tho.

I was told that when im married and my husband has lived in the state of california for a certain amount of time (he was born and raised in san diego and still lives there) that i can adapt his status and pay in-state tuition. I guess every state is different tho.

That sounds good, I guess I will have to talk to school and confirm this. My husband was also born and raised in Cali.

In terms of your F1 status, it won't really matter. You stop being under F1 status when AOS is filed and enter a bit of a limbo stage of "AOS pending". While your AOS is pending, you are authorized to stay in the US, and also to remain in school - but if you decide to stop taking classes, you also won't be violating your status. However, if you stop going to school, and for some reason your AOS is denied, you won't have an F1 status to fall back on. I'm actually not sure whether a person who files for AOS from F1, and has his/her AOS denied, could continue to stay in the country under the F1 status or not even if he/she maintained full-time studies while AOS was pending - but if you stop studying, you most certainly can't.

That being said, you can do whatever you think suits you best in this situation. However, as was pointed out earlier, in many states you have to be a permanent resident for a certain period of time, often a year, before you qualify for in-state resident rates.

as far as i know it doesnt matter how long you have,lived in a state on a NON-immigrant visa, you can only get instate tuition after living there a certain time or if you're marrief and your spouse has. But if he has lived there all his life, you should be able to get it as soon as you have your GC. It should be that way in the entire state, not just san diego. I looked into san jose state university and they have told me the same.
