Hi all,

I'm a newbie and needing advice. I plan to visit my boyfriend in Georgia this October for our 1st year anniversary and will be applying for a B2 visa. If ever we also plan to get married there so he can start the spouse visa process once I come back to the Philippines. Will this cause an issue or should we wait and apply for a K1 instead?

KarenSal: My 2 cents: If there is a pending immigration application (or if you are married), a B2 application gets rejected in most of the case (almost all) as it will indicate that possiblity for the applicant coming back is low. Being said that if your intention (not saying it is) is to bring him/her here and then apply for K1, that would also be considered as visa fraud. My suggestion would be this; let him come here on B2 and stay with you for the allowed time. While he is here, make sure you get him fully educated with the K1 or CR1 process (whatever you would want to go with), let him go back and you can get married there and and then you submit the application. By then all docs would be fully ready in your hand for the visa application. I am sure you will get many more suggestions as well :-) Good luck
