Saylin, one of the operator's at the NVC is telling us we need to include a Schedule C and 1099 for each tax year even if we provide an IRS Tax Trancript for that year. Is this true? One of my joint sponsors is self-employed. And I was self-employed last year and also have a tax transcript and wanted to know if I need to include my 1099, etc.. also?

Use of IRS Transcripts Instead of Copies of the Required Tax Returns

Another commenter asked whether the sponsor may submit IRS-generated transcripts of the returns. Under current IRS policy, IRS will provide transcripts, free of charge, if the sponsor files IRS Form 4506T. There is, by contrast, a fee for filing an IRS Form 4506, rather than the free IRS Form 4506T, if one wants to obtain an actual photocopy of the filed return. It is important to note that the interim rule did not require the sponsor to obtain photocopies of the sponsor's own returns from the IRS. If, as t he IRS recommends, the sponsor has kept photocopies or duplicate originals of the sponsor's returns in the sponsor's own files, the sponsor may submit copies of his or her own file copies. Section 213A requires the submission of certified copies, but the interim rule and the Form I-864 itself make it clear that, by signing the Form I-864, the sponsor certifies under penalty of perjury that the copies are true copies. The final rule does give the sponsor, substitute sponsor, joint sponsor, household member, or intending immigrant the option of submitting either photocopies or IRS-generated transcripts of the required tax returns. Along with the transcripts or photocopies, the sponsor, joint sponsor, or household member must submit copies of all Forms W-2, Forms 1099, and schedules, as specified in the rule.

NVC - MEP

2 JUL 2012 - Case Received at NVC

19 JUL 2012 - Case number, IIN and Beneficiary ID received, gave e-mail addresses!

23 JUL 2012 - Was able to log in and fill out the DS-261 and I made myself the agent! I also stated that I was assisting the beneficiary ( since I signed in as him )

24 JUL 2012 AOS fee available and paid through the payment portal - direct deposit

25 JUL 2012 AOS fee shown as paid!! I-864 package e-mailed to NVCelectronic@state.gov

01 AUG 2012 IV Bill Invoiced and paid

02 AUG 2012 IV Bill shown as paid and DS-260 completed and documents sent!

08 AUG 2012 RFE! :crying: sent passport photos wrong, so re-sent!

15 AUG 2012 case COMPLETE!!! Yay!!

13 SEP 2012 Received Interview Date! OCT. 5th!

20 SEP 2012 Scheduled ASC appointment by calling 7034392313. Two days earlier I logged into the website but it said there were no appointments available. But when I called, they scheduled an appointment for me. :)

Finally received my case number after 18 business days. But the operator said wait 8-10 days for the AOS bill!! We'll see how soon it shows up in my email inbox.

Don't miss the warning about EP for GUZ IV - is best to OPT IN after the AOS FEE BILL shows up in yer email inbox.

For now, when calling into NVC, ask that the AOS FEE BILL be sent out via email, and be certain to give over your email address and yer lass' email address, via telephone.

Operator is wrong. it's 'either / or' .

EITHER a tax transcript

or

a photocopy of the complete return (all forms, all schedules, everything submitted INTO the IRS)

If you checked box 9b (self-employed), you should have completed one of the following forms with your Federal income tax returns: Schedule C (Profit or Loss from Business), etc..... You must include the Schedule C that you filed with your Federal tax return.

where does it say that if you submit a tax transcript that you do NOT have to include the Schedule C ?

That would be silly. A tax transcript should encompass everything regarding your taxes. That's why we like it that much better. I went through a nightmare worrying and questioning info about my taxes too, but in the end I was making it much more complicated than it needed to be. Hope this helps - good luck!

I have been following the threads, timelines and information on this websites, I want to say thanks to everyone for their contributions. I learnt alot. To saylin, thank you for all your inputs and knowledge. I got a Case complete at NVC 8/8/12 and I give all glory to God for his mercies. I am so excited, and cant wait to be reunited with my husband. Thank you all.

yes, after reading into the instuctions I guess you are right. but they could of made the instructions more clear that if you are self-employed and provide a tax transcript you do NOT send in a copy of the 1099 or 1040 schedules. You have to be a detective and figure it out for youself.

Read a bit more - yer taking things OUT of CONTEXT. Those instructions are solely for copies of tax returns, cover NOTHING about use of tax transcripts.

You are on the right page, though, just in the wrong section.

thanks, it took me a while to figure out, but I came out with the same conclusion.

you are right, they do NOT mention transcripts in that paragraph.

remember, I am only making a big deal about this because we asked this question to the NVC operator and was told some false information which I have learned is quite common with the NVC operators.

now I can move ahead and have the I-864 pacakge ready to send out on Monday.

Along with the transcripts or photocopies, the sponsor, joint sponsor, or household member must submit copies of all Forms W-2, Forms 1099, and schedules, as specified in the rule.

plus when I read this, it sounded like I needed to include my Schedule C :bonk:
