To file an appeal would be to do exactly that. The appeal will fail, then several months later, they'll still need to refile but won't get that time back.

Nor the money. Appealing a denial that was correct and warranted is just a waste of time and money. You cannot appeal and say they were wrong to deny you when they were not wrong. Just because they give people the option of appealing does not mean you have grounds to win an appeal.

In other words, it is standard to offer the right of appeal, but in this case you are appealing against their decision and their decision can't be challenged, so you would not win. I doubt it will be quicker and it wont be cheaper. If you want an approval, I believe you are better to get a new petition on its way.

Hello fam, 

Trust u all doing great. 

I would like some help and education here. 

I filed for a K-1 visa for my fiancée in Ghana on the 17th of January this year 2012 and I haven't heard from them. I called a month ago and I told they are now working on applications dated 16th January. 

I keep checking my status and it's still on  initial review. 

Can anyone help or advice me on what to do since it's taking long. Nearly 7mths now. Wow!!!

VSC is a bit slower than CSC at the moment. Many are not getting approved until 6-7 months versus the 5 months average. At this point, you could try putting in a service request. Right now, you are only getting a standard response. It means nothing in regard to getting anything accomplished. You need to put in a service request. If that doesn't help, and your case has gone beyond 7 months, I would contact my local congressman to inquire. For future reference, your concerns can be better addressed if you start your own topic. Also, don't forget to fill in your timeline. It will give you an estimate of when your case will likely be adjudicated based on the statistics of other members, and it will contribute to those statistics so other members will have better estimates. This is how I know VSC is behind at the moment. :)

People keep asserting the statement "Be careful using Western Union receipts" apparently it could viewed as a business transaction OR BUYING HER LOVE. Just wondering where is the proof with this statement? What if Western Union receipts Actually HELP your case???

FACT: I sent Western Union receipts along with my I-129F and I got approved.

FACT: I sent Western Union receipts along with my I-129F and I got approved.

If your filing for a fiance in a high fraud country it can raise red flags, not saying it will. For instance if a 50 year old woman marrying a 23 year old man from lets say Nigeria (cause thats what I knw) well they already have an issue with the age difference, then the woman sends receipts of her sending the fiance money thats can make anyone think she is being used. It all depends on what are stereotypes in the regions your dealing with.

Unfortunately, the same thing happened to my husband and I when we first filed our I-129F. We were completely clueless to the correct steps and call us crazy, but we really did think that it was as simple as filling out a form and submitting a check. We assumed that evidence, etc. would come at a later time. We were denied right off the bat - of course AFTER they cashed our check. It was a very expensive lesson to learn and we were sure to make sure we did it properly when we re-filed. We just celebrated our 2 year wedding anniversary!

We all make mistakes do not beat yourself up too badly!

and speaking about this issue- we didn't include Western Union receipts in the package BUT brought them to the interview just in case. They were not even looked at.

From K1 submission to US Citizenship- 2 years, 1 month and 2 days!

K-1 Process
• 6 MAR 2012 - I-129F packet sent via FedEx overnight •

• 7 MAR 2012 - Packet received Dallas, Texas
• 12 MAR 2012 - NOA1 (Notice by Email: routed to the CSC)
• 15 MAR 2012 - NOA1 (received Official Receipt Notice (Form I-797))
• 12 JUN 2012 - NOA2 (Notice by text message and Email)
• 23 MAR 2012 - NVC received/forwarded approved I-129F
• 25 April 2012 - Interview and Visa Approved!

You filed for a Filipino beneficiary. The US Embassy Manila instruction packets for K-1 even state remittances as a form of evidence commonly and helpfully used at the interview. This is not the case for all consulates. It is safe to assume that remittances aren't a problem for the Philippines when the embassy is making it a suggestion of what one can provide.

Worst part is that I do not know why yet. It's been almost 5 months and I received an email yesterday just telling it has been denied and I should receive a letter explaining why. So needless to say I'm freaking out. At first I had no clue why, but after looking through this site, I think I might know. I pretty much only filled out the I-129F form and mailed that in with the fee, nothing else. I figued once the backgroud checks were done they would ask for more info for the interviews. I called USCIS 3 different times and talked to 3 different people asking them what I needed to do, and they all said the only thing I need to do is fill out the I-129F form and mail it in. They also mentioned the requiremens to be eligable, but that was it. I talked to a couple lawyers also, but they wanted a few thousand dollars to handle it. I did not get the letter yet, but should in the next couple days. I don't know why I did not find this site before when searching online. It came up now in my google searces on what to do about a visa denial.

So what are my options? Should I get a lawyer?

My background... My Fiance is from the Philippines, and I have known her for 5 years now. I have been supporting her for the past 4, I helped her go back and finish highschool, and she is now in her 3rd year of college. Originally we were going to wait for her to finish college, but I figured it would be better for her to finish here (USA) and get used to the culture, language, and build a network through school. I have a lot of (daily) chat logs from Yahoo, Skype, and emails. I also have a lot of Western Union receipts and Xoom online history of me sending her money. I have visited her and met her family 2 times now and gave her an engagement ring. We are both eligieble to marry and have no criminal background. Also neither one of us have been married before, or have any kids.

I thought I might be asked for clarification or more info, but I did not expect to be denied. Would not providing enough info or documentation result in a denial? I guess worst case is that there is something in her background check that came up, but knowing her as long as I have, I would be very surprised. I feel foolish now if it is just because I did not provide enough info. I waited a few months before mailing the form while trying to make sure it was all I needed.

Denied for "no petitionable relationship" You have to attach documents proving you have a relationship with the person you are petitioning. USCIS is under no obligation to send an RFE ever and when there is not something attached they can go by, then they usually will simply deny. You start over and read the instructions next time.
