Thanks everyone for the replies. I feel a little better, maybe I can sleep more than 2 hours tonight. I still don't know why I did not find this site before, it would have saved me a lot of worrying and now hassle. Like I said, it took me a couple months before I finally mailed the form because I did not know what to do. After talking to 3 different people at USCIS, and them all tell me I just needed to send in the form, I figured I was good and if needed they would just request more info.

Now, am I better off starting over and submitting a new I-129F form and all the info, following the guide on this site, or appealing the denial?

Maybe I am just jumping the gun and need to wait until I get the letter. I am just going crazy here and needed to sort of talk to someone or get some advise.

Hello, was reading your comments, Once you send the I-129F form ( Fiancee visa-K1) you need also to submit the documents the evidence

that you can support your fiancee and the rest of your documentation that you are a citizen of the USA, it's not all the money

you had been sending to her but like receipts,the e-mails communication, pictures of your visit to her, plane tickets that you were in the Philippines, phone calls, your W2 if you are still working/ retirement -if you are retired, and your payment :)...that's it if you can still add more that's better. Im very sorry about your Denial.. This website is a wealth of resources and information and has some really sweet people here that care.

He addresses the Congressional questions as well and I think you will find this helpful.

My personal opinion would be to wait until you get that letter then try you local congressman's office for assistance, its worth a shot :D

The thing is, I downloaded the I-129F instructions, and also the Fiance help pdf. None of them say I need to submit evidence of anything with the I-129F form. . . .

Sounds like to just need to re-file.

Definitely do not need a lawyer, just take the time to read and understand the guide here, ask questions on the forums...it is without a doubt a DIY project once you take a little bit of time to understand the process...best of luck

Ok....I will be the oddball here. I see everybody is addressing the I-129F petition and that is good. My concern is that the OP mentioned that his fiancee is in 3rd year college, and he would like to see her finish college here in USA.

I am certainly not judging, nor offering any advice....just want the OP to think about maybe his fiancee will nearly be starting college all over again. How many of her credits are going to transfer from Pinas to a University here? Just something to think about.

Good point. So many lose their college credit and stuff.

Hi same thing happened to me before...so just re-file it again and you will be fine

Jan,2008 we met each other for the first time
March 11,2010, I flew to Dallas to visit him. We started dating.
September, 2011, we made the most stupid mistake we could have, sending out packet I-129 application without putting in a single page of supporting document.
January 12,2012, we received our declined petition letter after 5 months :-(
January 20, 2012, I flew to Dallas to prepare the packet and sent out the fiance petition
January 23, 2012, we received our noa1
May 30,2012, we received our noa2
June 13,2012, Our case was forwarded to Montreal
July 4,2012, I received RFE
July 5, 2012, I sent out RFE
July 9,2012, Montreal received my RFE
July 16,2012, I sent out my Packet 3 (I did not call Montreal to confirm if they have sent out my Packet 3)
July 25,2012, I received my Packet 4 in email
September 4,2012 at 9:10 am, visa approved !!!

Thanks for more replies and advice everyone. I really appreciate it.

I have already been planing the refile and looking for my chat logs and stuff. I already have filled out G-325 forms. I just did not originally include them because the different people I talked to at the USCIS said I only needed the I-129F :rolleyes: I just wish I got her signature when I was there. Oh well... I will of course wait until I get the letter before moving forward with anything. I should have no problem proving our relationship. I don't have chat logs going back to the beginning, but I do have them going back until the beginning of 2009, along with emails, and money receipts. Not sure about call logs since I used a calling card and we did not talk much on the phone, we mostly used Skype and Yahoo Msngr. I met her and her family in June 2011, and have pics of me and her, and me her and her family. I was just there this last May, 2012 and I also have pics from then, and I even snapped a pic of the ring on her finger. I don't know why I took it, but I'm glad I did now and I will include it in the packet I send. I also have my tickets and hotel receipts from both trips, and of course my passport with stamps. I am self employed and will send a copy of my last W2 and corp tax statements. I think showing all the receipts and how I support her now should be enough to prove I can support her when she moves here and we get married.

Regarding school... education was always important to me and I stressed that to her when I first met her. I am not expecting most of her credits to transfer, but I feel the benefits of moving here before she finishes and giving her a chance to get more acclimated and build a network with classmates before jumping into the job market, outweighs needing to repeat or start over. Her field of study is IT and software engineering, which is what I do. So needing to retake classes or spending more time doing it, will just help her to better understand the subjects and hopefully learn more.

I have been reading the stuff on this site and I feel more confident about this whole process. I just wish I found it sooner. It sucks if I need to pay another fee, but the worst part is wasting 5 months. Lesson learned, nothing I can do now but move on and make sure I follow the guides on this site and include everything I can when I refile.

I will keep everyone posted and create a timeline.

Appeals are costly and take a very long time. There is nothing to appeal, you did not send in any evidence and that is the reason for your denial.

You must send proof of having met within the last 2 years, such as photos and proof that you communicate and many other items.

Follow the VJ guide to a T and start over. You don't need a lawyer.

Anything you don't understand in the guides, come back here and ask specific questions and you will get all the help you need.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

"On July 30, 2012, we mailed you a denial decision notice for this case I129F PETITION FOR FIANCE(E). The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days of July 30, 2012, please call customer service at 1-800-375-5283 for further assistance."

It sounds to me like they denied it because you didn't have the right paperwork, but it also states, "and the options that may be available to you". Maybe those options are to turn in the rest of the paperwork? I would just wait until you get the letter and see what it says, because it may just be that you need to send in more stuff. It should be there soon! Hang in there, it's stressful but worth it! :)

Calling a senator or congressman cannot help. USCIC are not answerable to elected officials.

If you get the letter from them, and you are indeed denied, your best option is to refile, following the guides and enclosing all the bits and pieces necessary to support your petition. Read the guide, you will find it is a valuable tool.

And the degree in the Philippines can't be used here. Nursing, they can take the bar exam twice including the one in the US, but all other degrees are useless here.

What do you mean by "used" here? Most of the people I work with did not get their degrees in the US. Also, the school she is attending is recognized here in the US, it even has campuses in the US, and is considered one of the best in Phil for IT/Tech. I doubt she will graduate from the school she is at now, provided everything goes OK with the visa, but even if she did, I think a degree from a good school with an appropriate curriculum will work fine at getting an entry level job in IT here in the US. While some degrees might not go too far here if acquired in Phil, I don't think she would have any problem.
