well, if he's of a certain age, he can file with USCIS after August 30th.

Well is your friend married to a US citizen or dating one and possibly getting engaged? And no I am not suggesting he marry someone for a visa. But if that isn't the case then your friend should go home. Ppl who stay here illegally are the ones who make this visa process take so long.

The term "illegal" can mean two different things. Your friend's options will depend on which kind of "illegal" he is.

If he entered the US with some kind of tourist visa, legally, after talking to a US border officer, at a normal border checkpoint, and then overstayed, he may have the ability to normalize his status, but only if he is married to a US citizen. He should be warned that his relationship will be scrutinized very carefully by USCIS to ensure that his marriage is legitimate and he didn't just do it for a green card. Both him and the US citizen can get in a lot of trouble if they married just so he could get a green card.

On the other hand, if he snuck across the border without being inspected by a US border agent, the above posters are correct - there is no way he can legalize his status without returning home (and relatively little hope even then).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
