Hello everyone!

I need help understanding if my son qualifies for CSPA. My brother (US citizen) filed a petition in which I'm the main beneficiary and both my wife and son are also beneficiaries.

I've used the CSPA calculator and it said my son still has the right of obtaining the visa.

Here are the dates of our case:

Date of Birthday: Apr. 5th 1988

Process Priority date: May 23rd 2001

Approval date by USCIS: Jan. 22nd 2010

Visa bulletin date for August (F4): Feb. 15th 2001

Did I get it right? Is he eligible?

In this case should I do anything to inform NVC about the CSPA or they will figure it out by themselves?

Usually it doesn't take that long for the approval. Are you sure of that date ? Normally it is about a year

Yeah, I'm sure about the date. Below is a copy of the notice received by me.

"Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN.

Current Status: Approval notice sent. On January 22, 2010, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN...."

This notice was sent by USCIS.

Timeline

Wow they put that one in the process slowly line. Anyway CPSA cover the time from your priority date to the approval date so you can deduct that time from your sons age. Haven't heard of that big of a gap in forever. Make sure they are aware that your son still is "under 21" they can double check if they wish but you seem to be good.

This will not be over quickly. You will not enjoy this.
