IR-5 for mother, no marriage certificate for DS-230

Hello VJ members,

I tried this same question in regional forum but no one seem to know so I thought to ask the question here. My husband plans to petition for my mother-in-law. Looking at the process, she'll be required to submit a marriage certificate as part of DS-230. My in-laws did not register their marriage and my father-in-law has passed away 20+ years ago. Additionally, my father-in-law's parents have also passed away. So my question is, do we need to submit anything in place of marriage certificate? Is marriage certificate required if only my mother-in-law is being petitioned for? Do we need to submit affidavits or other secondary proof because she does not have marriage certificate?

I would really appreciate it if you can share the experience. Thanks for your time and help.

I never have to deal the case like this before. But logically, I think, following can be done.

1. He passed away 20+ years, She has taken over his house, property, will.

2. There must be something that family members can provide about this.

3. May be the local court or marriage registrar can provide some thing, like she is window of person.....

4. Family members affidavits.

Lets hope it work for you.

I appreciate you always chipping in with your suggestions. There is definitely nothing in the court/registrar for sure. You're right though, there are some things that can show the relationship:

1. Indian Ration Card typically list (husband, wife, kids) etc.

2. My mother-in-law has taken my father-in-law's first name as her middle name. So now her full name goes like <Her-first-name><father-in-laws-firstname><last-name>. Other similar documents like voter-id card and such will show this same format.

3. I don't think there was a will by my father-in-law. The property is currently shared by mother-in-law and her kids (including my husband) so it doesn't have father-in-law's name.

4. A letter from either town official or registrar office stating that there was no marriage registered for them.

5. Lastly, I do plan to get an affidavit fro my mother-in-law and her mother.

6. Include father-in-law's death certificate.

If I don't hear anything from VJ members about this question then I'll pursue above documents as proof of relationship. It doesn't make sense that NVC would want marriage proof from a widowed mother but I prefer not to question and just provide as much documentation as I can to leave no space for doubts.

Could you please let me know what you presented for the marriage certificate ? My mom also does not have her marriage certificate. She has interview on Jan 30th and they have asked her to get the marriage certificate to the interview. We provided affidavits from 2 family friends regarding the marriage. I don't know why they are asking for marriage certificate again. Did they accept the affidavits ? Did you provide anything else ? Please do let me know.

champi and shivani_raj - I am in the same boat as you both. What did end up for your case? Would just 2 affidavits work?

My mother passes away some 19 yrs ago and there is no marriage certificate for my father's IR5 papers. I have got 2 affidavits from relatives that mention they got married. Would that be OK?
