hi everybody !! our i-751 petition got denied after 3 interviews so we will go to an immigration court.we have a lawyer and we are happy merried for like 6 years,my wife is us citizen and, while our case is in court and waiting for individual hearing ,can we travel outside of usa!! thans

No, unless you have an extension letter or an I-551 stamp in a passport.

Before he takes your advice, can I ask if you are 100% sure that you are correct? If the petition was denied it would seem to me that the validity of the extension letter would be in doubt.

Juliava your informations is wrong. The extension letter is granted by USCIS solely to allow one to return to the United States while ROC is pending. Gocedelcev you have been placed into Removal proceedings, because of that you have a individual hearing, the Immigration Judge will decide your case.DO NOT travel outside the US while your case is pending. When did have the master hearing?. Usually Immigration Court set up the individual hearing after 1 year of the master hearing.

Before he takes your advice, can I ask if you are 100% sure that you are correct? If the petition was denied it would seem to me that the validity of the extension letter would be in doubt.

Mike B - My answer started with the word "NO", that means no, he may not travel unless he has the proper documentation. When I say "An extension letter" or "an I-551 stamp", it is implied that these documents must be valid.

Please don't twist my answers.

ok ,ok !!my lawyer said that after the master hearing i still have the right to travel because the i-551 stamp will be extended which means that my case will be pending the way it was until the judge does not make the decision.right now i have the i-551 valid till end of september.

OP - if I were in your current situation, I would not travel outside US. For my own piece of mind, I would wait until I receive a final decision.

You said "No, unless you have an extension letter or an I-551 stamp in a passport." The extension letter that he received, however, would not authorize return to the US. In other words, you were DEAD WRONG. If you are not sure of the answer to a question, DO NOT ANSWER IT. It really is that simple.

oook, mike b. and juliava i think that im gonnna ask an expert or at least somebody that knows how to read and understand that part of IFA.one saying yes ,second saying something else it s just one of those situation where inexpirienced ppl like u are just guessing in the middle of nowhere and creating more negative add on to the whole situation and the conditions in to the immigration world!! thanks!!

Also, as this is a very active public forum, you should expect diverse opinions and levels of expertise when it comes to immigration issues. I am sorry that the answers to your questions did not sound very good. However, in your situation, you cannot count solely on what's being said here. Your current immigration situation is definitely serious and quite atypical, no doubt about it; as it looks like you have been placed in removal proceedings, the validity of any documents you may have that allow you to travel ouside US is questionable. Therefore, you must check if the validity of an I-551 stamp for example still stands up for you. Talk to your lawyer again, schedule an infopass, talk to an admission officer at the airport, call USCIS...you do have multiple options to find out exactly where you stand in regards to travelling outside US.

thanks juliava!! my respond was mostly aimed toward mike b.or his mid play activity!! i spoke to my lawyer and ill send u a message after 22 avgust the first appeal at the court!!
