Vermont behind on K1 processing

How did you hear from them?

I called the 800 number on the NOA1 and spoke to someone there. They asked for my receipt number and then i guess when they found out when it was filed they decided to make up a story about January filers getting processed.

I guess there is nothing i can do.. if they lied to me or not i still have to wait... but i dont think its right

January filers are being processed, in fact there is many of us still waiting so I don't think anyone lied to you ...

The fact that you see some petitions for Feb being approved, doesn't mean USCIS fully moved on to February. There are hundreds of January filers still waiting. And yes there is not much anyone can do but wait... I know, I have been waiting 193 days now.

Actually, there are rights. I'm a December filer just FYI before you make any remark. As filers we have rights to know about our cases. We prove our identity when we give them case number, address, and social security number. Do you need to read the FOIA and Privacy Act? However, the last few times I called I was denied rights. A petitioner has the right to put in a second service request when 30 days have passed since the response from the first service request and no approval was made. I was denied. Idk... maybe the rep was having a bad day. The other time, the tier 2 rep would not tell me if my case has been assigned or if there was any AP status or anything holding it up. NOTHING THAT WOULD REQUIRE A WRITTEN FOIA REQUEST... and I was denied. So yes, it does happen.

oh dear! December filer and you still haven't got your NOA2? This sucks...

I don't know how true it is, but I heard that VSC was backlogged due to them working on the "protected status" of syrians here in the US so they will not be forced to go back to their war torn country at the moment..if that is the case, I could understand why any syrian citizen wouldnt want to go back during the craziness over there...but c'mon..we are US CITIZENS and should be treated first..maybe that sounds selfish, i dont know..but I highly doubt they would put us before them if the shoe was on the other foot.....hopefully we'll see some steady action soon..hang in there guys..we can make it! :)

Wow. that is crazy that you're still waiting. have you talked to your representatives? Congress? Senate? There has to be something they can do at this point. They should be able to at least get you some information on the status of the case. You're way outside of processing times which gives them more power to at least get you some information and maybe bring enough attention to your petition that someone approves it.

Hi, no it's completely true. Sorry to say.

If you go to the United Kingdom section, there's a thread called January K1 filers. Some guys there have now been waiting 194 days.

Timeline:

Dec 31st 2011- I-129F sent
August 2nd 2012- INTERVIEW- APPROVED
August 10th 2012- Visas received
August 21st 2012- P.O.E Boston!

September 11th 2012- Applied for SSN.
September 16th 2012- MARRIED!!!
September 17th 2012- Received SSN.
October 26th 2012- Sent off AOS forms.

January 16th 2013- EAD and AP card issued.
January 26th 2013- Card received in mail.

May 29th 2013- Service request, as outside of processing times.

June 25th 2013- Green card/EAD stamp received in passport. Green card production ordered!

July 5th 2013- Green card arrives :)

August 22nd 2014- Daughter Born!

April 17th 2015- I-751 Sent.

April 20th 2015- NOA 1

June 2nd 2015- Biometrics Appt.

February 2nd 2016- I-751 APPROVED! 10 Year Green card issued!

 

February 22nd 2019 Applied for Citizenship! 

March 14th 2019 - Biometrics appt.

April 23rd 2019 - Interview. APPROVED!!!!!  It took 60 days!!!

i sent my i-130 package to USCIS on 9th july and i haven't received my NOA1 yet accroding to my Wife zip code i'm suppose to get VSC. and infact i had my i-129f before this petition i got my NOA1 in 13 days and NOA2 in 94 days at that time back in 2011 CSC was processing Very slow and VSC was faster in Approvals. now its totally opposite VSC taking more than 3 weeks to give NOA1 and more than 5 months for NOA2. i had my wife called USCIS all they are saying i have to wait 30 days. i emailed VSC yesterday and waiting for the respond.

Oh, yes. Jun 29 was the time I called and was connected to the tier 2 who refused to divulge any information. All I got was "even if it doesn't say assigned means nothing. It can pass through many hands and when it waits after passing hands it can show as not being assigned to anyone." I did specifically ask "can you tell me if there is anything holding it up? Can you tell me if it's under AP status?" and I got only "I can't tell you that". But on Jun 22 I contacted the congressman. I got asked for the privacy release on Jul 6. I sent him it July 12. July 20 is when I got a reply saying he called and it is currently with an officer and to wait 30 days. Also he said he will inquire again in 15 days. One thing to notice is that the first service request 60 days is up on Aug 1.

wow. yes. it's been a long wait. I've been sort of left behind too now in my group of petitions. Hopefully the Congressional influence will help you get out of VSC with an approval soon. Looks like a few petitions always seem to fall through the cracks....good luck!
