Hi VJ members,

Has anyone had any recent experience in the US Embassy in Manila about the CRBA (Consular Report of Birth Abroad) as I stated back in my old topics my fiancée was pregnant during our K1 petition and she just gave birth late April and her petition has been approved and we are now at the US Embassy stage anyways I'm planning on taking a trip to Manila around November I'm gonna take 3 weeks off my job so I could get my son his US passport thru the CRBA in the US Embassy in Manila, does anyone have any tips and experience they can share with me so I may know what to expect also does anyone know how long will it take to process including the delivery of the CRBA and passport? My fiancée and I have all the documents set for him except one thing I did not sign my sons birth certificate because because I wanted the BC to be registered ASAP in the NSO plus they told my fiancée at the local civil registry that I had to be present to sign the BC or they will not accept but some places in the Philippines do accept it signed without the father present, do you think I might have to do a DNA test? I don't mind it if it will make the US Embassy happy but does anyone know how much does it cost? I am also planning on going back with them here to the US once my sons CRBA is approved and delivered same goes for my fiancée once her VISA is approved and delivered just so I can save some money and hassle for the both of them. My fiancée has her interview around September so I hope everything goes well we didn't get any RFE or anything and it took about 5 months for it to process from USCIS to NVC now it's at the US Embassy in Manila. Anyways thank you guys for your time in reading this any tips, experience or advice shared will be taken into consideration. Thank you again guys!

Out of wedlock children seem to be put under more scrutiny, your name not on the BC may not help. Burden of proof is on the petitioner and/or parent to establish the claimed relationship, Make sure you have strong evidence to establish the relationship.

If not all you have left is DNA testing to establish a biological relationship. From what I gather it’s somewhat costly

Good Luck

i applied for CRBA for my daughter who was born in december 2011, thinking i could pass my US citizenship on to her, but unfortunately, was denied due to the fact that i did not meet the 5 year physical presence requirement. i was 4months short for their 5yr requirement. ugh! sucks. :( i paid fees for crba application and passport applic., since i was denied, they refunded the fee that i paid for the passport but not for the crba :( about your sons BC, you dont have to sign on it, as long as it says you are the father, then all is good. but i guess you have to check with them, coz your son was born out of wedlock, if i am not mistaken... hope your application goes well. goodluck!

key provisions of U.S. law regarding the transmission of citizenship by a U.S. citizen parent or parents to their children born in wedlock outside the United States. (Please note that separate transmission requirements apply for children born outside of wedlock. Contact the U.S. Embassy/Consulate for further information if this is the case.)If both parents were U.S. citizens when your child was born, he/she may have acquired U.S. citizenship at birth, if at least one parent resided in the USA prior to the child’s birth.

If your child was born on or after 11/14/86, and only one parent was a U.S. citizen at the time of the child’s birth, the child may have acquired U.S. citizenship at birth if the U.S. citizen parent was physically present in the USA for periods totaling five years prior to the child’s birth, at least two of which where after their 14th birthday.
