I have not yet filed my taxes for 2005. Can I just send my w-2?

Also, do we need the actual complete tax return or can we supply tax transcripts. They contain the same information. Please advise.

Will I get an RFE for sending the transcripts as opposed to the complete return?

The tax transcripts from the IRS are all you need.

If you are submitting your AOS application in the very near future, the W2 should suffice because you aren't required to have filed your 2005 taxes yet.

Double check the requirements; on page 3 of I864 it specifically asks you to submit forms W-2 if you filed jointly, otherwise you can just submit the return or transcripts. Good :Luck

IRS transcripts are fine. However, if you have not yet filed 2005, you should send your 2004 tax return as that is your last tax return. If you want to err on the side of safety, you can send the last three years of returns -- 2002, 2003 and 2004 in this case, per the instructions. (I am aware that the new memo says you only need to send the most recent tax year, so that is an option as well).

You may include your W-2s for 2005 as additional information, but that should not be sent in lieu of "your most recent tax return" as they are clearly not tax returns. If I could give you one piece of advice, I would say, follow the instructions *as they are written*, not as you think they mean.
