Hi Vjers,

My Status: I am currently on OPT and working on my 1 year OPT EAD. I entered the US on a Student F-1 visa. I got married to a USC recently and we are planning to file for my AOS along with I-130, I-765 form.

I have a question regarding form I-485.

Form I-485 instructions: Point 12. Evidence of Eligibility – I believe given my status above it is option “A. Based on an immigration petition”. My question is do I need to submit a copy of form I-130 as a proof that a visa number will be immediately available or I don’t have to because I am submitting both the forms concurrently?
