We have been married for less than two years but we received a 10 year GC (AOS from B2 through USC). At first, I thought it was a typo but the same expiration date is written twice on the back (on the magnetic strip and at the bottom with the arrow separators). Could this be a mistake? Has anybody experienced the same situation?

Does the IO have the authority to make the call?

This has happened to a couple other people on the forum and the outcome has been clear. It is a USCIS error and your card does expire in 2 years even if it says 10. It will be easier on you at ROC time if you bring this to their attention and get it rectified now. You are still responsible for filing for removal of conditions. An IO does not have the authority to issue a 10 year card to someone who does not meet the eligibility criteria. Good luck - it sucks that something that feels like a good stroke of luck is actually just more hassle with USCIS.

Are you close to being married 2 years?

I asked this awhile ago, because we'll be just a few months short of 2 years when we go for our interview, and I was told in no uncertain terms that it would be a 2 year green card.

6/19/2012 - Biometrics completed.

8/02/2012 - Interview @ 2:00

8/02/2012 - Email notification of GC production at 5:30pm

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

8/10/2012 - Green card received. :)

Unfortunately the law is quite clear in that USCIS administrative errors in your favour will not be upheld.

Suppose you did nothing, and then in three years time decided to apply for citizenship. As part of that process they would examine your previous green card application, see that it was erroneously issued for ten years instead of two and since you didn't file for Removal of Conditions could well refer you to ICE to begin deportation proceedings at that point. You might be able to get it straightened out, you might not. Either way, you're lucky because you now know about this ahead of time and can contact USCIS in order to have their error corrected.

Bring it to their attention. If not you may have a lot of trouble with ROC or not be able to ROC at all and that will be a huge problem down the line. IOs do NOT have that discretion.
