So, I know we have 90 days to get married once in my hubby to be arrives. After that, do we need to file AOS during that 90 days as well? So lets say he gets here, we get married on day 30. Do we have to file AOS with the last 60 days of his I-94? I've read a few things on here that lead me to believe AOS does NOT have to be done in the 90 days, only the marriage.

What is the time frame that the AOS must be filed after we are married?

You must marry within 90 days. Filing AOS is ideal within 90 days but can be done after. Going into longer than a year or so past that time you may have to file an I-130 as well to process because you would not be considered a K-1 entrant.

You must marry within 90 days. Filing AOS is ideal within 90 days but can be done after. Going into longer than a year or so past that time you may have to file an I-130 as well to process because you would not be considered a K-1 entrant.

Other considerations:

Together with AOS, you file concurrently for work permit (EAD) and advance parole (AP) at no extra cost. Given recent times process times, you might want to file asap so EAD and AP is in your hand. You need AP to travel out of the country (such as emergencies), while EAD allows to work before the green card is approved.

The general recommendation is to start the AOS process as soon as practicable after your marriage, for the reasons mentioned earlier.

There is no deadline to file for AOS. You just have to marry within the 90 days. However, you should file for AOS as soon as possible so you are able to get a drivers license, attend school, work, or travel outside the US and re-enter. There are many threads on this topic. A search here on VJ will probably get you more than enough information.

It is two years. If you wait until you have been married 2 years already, then you should file the I-130 along with the I-485 so you will receive the 10 year card and not have to do ROC.

If you wait until your medical is year old or older. Then you must pay to get new medical done from a civil surgeon as well.
