Got married last March 17 then April 9 went to Philippine embassy to renew my passport then asked them if I can use my married name so i handed them our marriage cert but then I don't have my divorce paper to me that day :bonk: ...

Instead of going back again I just let them renew it with my maiden name

So i got my new passport with my maiden name but signed in married name...

I was thinking if I can change it again to my married name although it will expire on 2017?

And is it a big deal when we come to our interview with my maiden name in my passport and i renewed it while I'm already married????

Just waiting for my interview notice so I wanna lessen all the possible red flag :help: ....

Where does it state that the wife shall take the husband's family name? That being said, no it does not matter if you applied for a passport after getting married in your maiden name. I am assuming by all this that you applied for the AOS in your married name and now you have a passport in your maiden name and the GC will be in your married name--like most of the women who use the K-1. It is just that you wanted the passport in your married name--correct? If that is what you want then change your passport--when you do this is up to you. The USCIS really does not care about the lastname as long as you can show them the trail of name changes throughout your life.

The worst that will happen is you have an interview and at that interview the IO asks, "I see your GC is in your married name and you recently renewed your passport in your maiden name and signed it i in your married name. Why is that?" You then state what you have written here. I see this as a non-issue.

Good luck,

Dave

you're welcome. I also have this dilemma because my H-1 status and my passport are both under my maiden name .. but I was told by my employer's law firm to just carry my marriage certificate to show the name change and everything will be just peachy. :)

if they ask why you renewed your passport in your maiden name, explain what you've said here then - but they will not question why the names are different because you have your marriage certificate.
