Once i have k1 can i still enter on my b2 or crewman visa?

Hi everyone, got a b2 and crew visa due to my job - just wondering if ill still be able to use these once k1 has been issued? Are there any rules we need to know about?

Usually no, the K1 will be used the first time you enter after it is in your passport. There have been a couple of instances of Canadians crossing the border (they don't need visas) without activating a K1 but I would not count on it.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

After your K1 is approved at the interview (before they even stamp it on to your passport) they will cancel your B2 with a stamp that says "Cancelled Without Prejudice", so no, you won't be able to use it anymore. I don't know about the one from crewman, but I'm assuming they will do it to that one as well.

Hmm maybe its something i can mention to them at the interview. The b2 im not too worried about but it would be beneficial to still use my crew visa while i work my notice. Any more opinions? How sure are you that they will cancel the b2?

Work a month after i resign. My employer will be fine, if im going to spend a life time in the usa i can go a month without it im sure! So interview can be delayed? Could be an option. I just keep reading stories of noa2 coming from csc in like 100 days and we are at day 50 now so trying to be as ready as possible. I wasnt expecting to have tp resign till february but if things stay the same could be sooner.

I don't know if I'm following everything you have planned but---

Say your B2 and crew visa are cancelled. When you enter the US on your K1, it's also cancelled so to speak, because it's a one-time visa. At that point you have no way to get back in the US so don't head out to Lagos.

Solution:

  1. Work your notice and be free of your employment travel before you enter the US.
  2. Enter the US on K1, marry, apply for AOS, and Advance Parole (AP), and work authorization (EAD). The AP will take 60-90 days to arrive and allows you to re-enter the US from international travel. Once you have the greencard, you no longer will use the AP. It's a temp travel card while you wait on the greencard.

Oh yes i know that! Sorry i meant in the time after my interview that i have the k1 and in my last month of employment at the airline i will swap off us-bound flights. I wont be leaving the us for a while after that. I am hoping to fly to san diego a couple of weeks after my last day with the company. Its going to be a sad/happy few weeks :/

Then yes, you can go anywhere but the US with the K1 visa in your passport. You might even be able to talk your way through US immigration with your crew visa, explaining you are still working and not immigrating on the K1 yet. But you never know what the one guy (with the final say) on the CBP desk that day will decide, so kinda risky.

I agree. I am pretty sure they can't stop you from working - but as you say, its not worth the risk! I'll just explain to work the situation and stay away from the US until I am ready to immigrate. Thanks for replies.

Hello,

I will advise you to request some info from the case worker when y have yr interview. Crewmenber visa might be needed for y when in transit so y dont have to pass immigration or pass with yr team.it is another story if yr final destination is the usa.Y might as well qsk yr airline as they will be aware of the immigration law and have immigration companies work for them
