I agree with Harpa.. if you have read the instructions for the forms, and the VJ guide, you should know the answer to your last question. If you were to send your AOS package without the G-325 and I-864, it will boomerang back very very quickly.. You actually need more than one G-325. If I were you, I would re-read the instructions, and make a clear list of everything that is listed in those instructions as necessary supportive documents and forms for both I-130 and I-485.

The instructions have a clear examples list of documents that can be used as proof of bonafide marriage. The VJ guide basically gives you a step-by-step account of what is needed. Just take your time reading them through, and then come here to ask for more questions if something is unclear. The more insecure you are about what you need to send out, the bigger then chances of you missing something or overlooking something.

You might also want to google something like "items needed to file AOS". When I was putting my package together I mainly used the VJ guide but I checked multiple sources so I was really sure I understood what I was supposed to do. Also, if you search for "cover letters" on this site, you will get some good lists of what people sent and how they arranged them.

Hello Everyone,

I am a non US citizen just got married with American citizen and now living in the US, However, I am here got married on a tourist visa. We got married last week. I have been in US for approximately 120 days. My tourist visa expires in 2014, but according to the I-94 I must leave the country by November 8, 2012.

I have been with my fiance (now my husband) for about 3 years and he has traveled to my country and I have been to USA several times. I do not want to be deported or returned to Indonesia after marriage. What do my fiance and I have to do in order to avoid problem with immigration and adjustment of status.

And will i be able to get SSN as soon i got my a certified copy of marriage certificate and what is requirement to get SSN.

Thank you,

MSN

If you did not visit the US with intent on getting married, then the above advice is spot on.

Your husband only needs to submit the affidavit of support and the documents to support the affidavit of support. The rest of it is yours to fill out. It's your application so it's your i-485 that you also sign. The i-485 instructions almost give it away by stating "YOU may apply to adjust status if(...)".

Read the i-485 instructions here please; http://www.uscis.gov/files/form/i-485instr.pdf

From page 3, it shows which evidence is needed and crucial. some of it will not apply to you. If you have never been married, then ofcourse you don't need to submit a divorce decree, and you can move on to the next piece of evidence you need instead.

K1 process, October 2010 > POE, July 2011

I-129F approved in 180 days from NOA1 date. (195 days from filing to NOA2 in hand)

Interview took 224 days from I-129F NOA1 date. (241 days from filing petition until visa in hand)

From filing I-129F petition until POE: 285 days

Click timeline or "about me" for all details.

AOS process, December 2011 > July 2012

EAD/AP Approval took 51 days from NOA1 date to email update. (77 days from filing until EAD/AP in hand)

AOS Approval took 206 days from NOA1 date to email update. (231 days from filing until greencard in hand)

From filing I-129F petition until greencard in hand: 655 days

In the case of the I-130, your husband is the petitioner. He should be filling that one out. The I-485 is your form, you're the applicant.

Once you really start filling in the forms it will make more sense.

Hello VJ

Thanks for sharing info. Ok, i start to collect documents now, and i have schedule for Medical Examination an Vaccinnation today. i have question when i fill the form I-485 and report Medical, since i am now married can i use my husband last name (taking his last name) as my surname and i keep my middle name. In future i wanted to have my husband name in paperwork so thought would be easier if i start using it while it now..

No, you won't be able to get a SSN until you at least have your EAD, which will come part way into the AOS process. You could look into getting an ITIN now (that's a taxpayer ID number). I'm not sure if you qualify, you can look on the IRS website. But it will substitute for a SSN for many things.

Other than that, you should look around for banks that will let you get be a joint owner without a SSN. Joint lease, any bills in your name, and picture will work too. You can be beneficiaries on each other's life insurance. Stuff like that.

Also, don't worry about the bona fide stuff right now. You don't have to send everything now, you can bring stuff to the interview.

You should be able to get a rent agreement in both of your names. Also utility bills in both names.

My husband's bank put me on his account no problem, and I didn't even have a visa (came on the VWP).

Maybe try another bank or ask to speak to the supervisor.

At the interview we had: rent agreement in both our names, water bill in both our names, internet/cable in both our names, bank account in both our names. We had no problem whatsoever.

Join apartment lease or join bank account doesn't require an SSN. When I opened my Bank account and later a join bank account with my husband and also sign our apartment lease contract, all I needed was my passport.

Yeah, getting a Nordstorm membership card requires an SSN but opening a bank account doesn't, lol.

For the water bill, might as well try to add your name. Even if you can't send it with your AOS application, you can bring it to the interview.

Get a bank account together if you can. Does he have health or life insurance that he can add you to?
