Hello VJ members,

Let me start with a little background information. My wife came here on a K-1 visa and she received a 2 yr conditional GC. The time has come to file a joint petition to remove those conditions. I kind of dragged my feet for two months after the three month window started. Now we have only one month left. I gathered all the documentation that was required for the petition. I made a copy of everything to keep for my records. I went to the post office and mailed the petition along with a check for the application fee. I mailed it express mail, so it will be at the USCIS California Service Center sometime on Monday. Here is the problem that I have. After I returned home from the post office, I put my copy of the petition in a heavy duty report folder. Well while adding the pages to the folder I noticed that there was only 2 pages of the I-751 in my copy. What the @#$% ! ! ! I looked at every page I had numerous times but it was not there. I did not double check the original petition before I sent it. Somehow, somewhere along the way I misplaced the second page with all of my information on it. Now with only a month left to file, I fear they will not process the petition and my wife will become out of status. H E L P !! What can I do now? Can I call USCIS Monday and explain the situation? Will they return my entire petition (with the filling fee)? I would certainly appreciate any and all comments pertaining to my situation. Thanks in advance for your help.

no need to panic -- there might have just been a misfeed on the copier that page 2 got stuck on page 1 when you were making copies.

it wouldn't hurt to call them on monday and explain your situation. i'm sure they will give you some kind of advice on what to do or what to expect.

i'm not an expert, but i think there are a couple of scenarios that could happen:

1) CSC will issue you a NOA1 upon receipt of your application which extends the GC for 1 year. You will surely get an RFE for incomplete documentation.

2) CSC will return your whole package.

Since you stated that the GC doesn't expire for another month, i think you have enough time to make corrective action if scenario 2 happens.

Watch out for the check... if the check is cashed, NOA1 is on the way.

I'm hoping that it will be as simple as you stated. I will call them this morning and hopefully get some good information about how to proceed. I truly hope that someone else can learn from my mistake. Always double check everything you send to any government agency (USCIS,DHS). Make sure that all your T's are crossed and I's dotted but most of all, remember to check every page of you documentation.
