I-864 and I-864a are different tax years...

I've filed for my husband and I used my father as a joint-sponsor. He filed an initial I-864 for 2010 tax year and my step-mother filed an I-864a for 2010 as well.

My stepmother's papers were fine, but I got an RFE (twice! haha) for my dad because he's self-employed and that kind of confused him on lines 23/24. We call the NVC and they said that my husband can bring in the corrected I-864 with the correct income amount to the interview.

During this time my dad/step-mom filed their 2011 taxes. So my dad's I-864 has the 2011 tax info and my step-mom's I-864a has 2010.

Is this a problem?

Between my I-864 an just my dad we meet the 125% guideline. The RFE never mentioned anything for my step-mom. But my concern is that it's 2 different tax years.

Also on the I-864 we have the bring to the interview should i check the box about the above family member having filled out the I-864a or leave it blank ( this question seems obvious however...I'd like to double check)

Should i put a note on the I-864 mentioning that my step-mom has already filed the I-864a and check the box?

Worst case scenario is that I need to have my dad overnight some information to Nairobi and hope that it arrives while my husband is there.

Aug 9 2011: I-130 mailed to Chicago Lockbox

Aug 11 2011: Email recv'd advising I-130 received, case number received

Initial Review Status Sent to California Service Centre

Aug 16 2011: Check cashed

Aug 22, 2011 NOA 1 for I-130 recv'd (hard copy)

Aug 23, 2011 Sent I-129F packet to Texas

Sep 02, 2011 NOA 1 for I-129F recv'd via email (USCIS.gov says they recv'd it on Aug 26, 2011)

Let the waiting begin...

Sep 06, 2011 Touch (adding I-129F to USCIS case tracker online I assume)

March 06, 2012 NOA2 recvd via email for I-129F and I-130 :D (also switched to ir-1)

April 3, 2012: Paid fee for AOS with CEAC...

Took us a while to get civil documents together because I failed to notice that the police certificate needed to be sent in :(

May 18, 2012: Paid IV Bill

Aug 7, 2012 INTERVIEW @ NAIROBI!--APPROVED!!!

Sept 3, 2012 POE @ Minneapolis

Timeline

You and your father are not combining incomes, so it doesn't matter if you reach the 125% between the 2 of you. Your father and his wife are combining their incomes to be your joint sponsor. They need a combined income that meets or beats the 125% requirement for their own household size plus your husband. Have your father fill out a new I-864 and his wife do a new updated I-864A and use their 2011 tax returns. I think it would be best to have both of their forms and incomes up-to-date for the interview. Make sure their tax returns(or single return if they filed jointly) are complete copies of the returns with 1040 forms, all schedules, attachments and any 1099s and/or W-2s.

Line 22 of the most recent 1040 is the amount used for current income for those that are self-employed.
